NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated April 21, 2020, executed by Borrower, Christopher Daniel McKinney, to Keaton Frazer & Milleson PLLC, the Trustee of record in the office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 647, at Page 743. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 31631 Northwestern Pike, Romney, WV 26757. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 3, 2025, of record in the Clerk’s Office in Book 724, Page 267. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on the following date:
June 10, 2025 at 3:08 p.m.
All that certain tract or parcel of real estate, together with all rights, privileges, improvements, rights of way, and appurtenances thereunto belonging, or in anywise appertaining, situate on the south side of United States Route No. 50 and contiguous thereto, approximately one mile east of the Junction Post Office in Mill Creek District of Hampshire County, West Virginia, and more particularly bounded and described by metes and bounds as follows: BEGINNING at an iron stake found on the south side of U. S. Route 50 and corner to Ray Doman, Deed Book 173, page 364, thence with the South limit line of U.S. Route 50, S. 83 33 00 E., 308.75 ft. to a 1/2” X 24” rebar set on the south side of U.S. Route 50, thence leaving the road and with a new division line S. 24 46 10 W., 251.01 ft. to a 1/2” X 24” rebar set near the bottom of a slope, thence N. 88 54 10 W., 214.09 ft. to a stake and iron pin found and said to be a corner of Ray Doman lot of 2.47 acres, thence with his line N. 02 55 00 E., 258.36 f. (275.2` called for in the Doman deed) to the beginning, containing 1.47 acres, more or less, as surveyed by Larry L. Kitzmiller in June, 1977. Said real estate is depicted on the Hampshire County Land Books as District 06, Tax Map 8, Parcel 25. And being the same real estate conveyed unto Christopher Daniel McKinney by deed of Gloria J. High, dated March 10, 2020, and recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book 563, at Page 812.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
