NOTICE OF TRUSTEES’ SALE
By virtue of that certain deed of trust dated April 22, 2019, made by Aaron Lowell James and Jenna M. James, to W. T. Weber, Jr., and W. T. Weber, III, Trustees, which said deed of trust is of record in the office of the Clerk of the County Commission of Braxton County, West Virginia, in Trust Deed Book No. 252, at page 703, by which said deed of trust there was conveyed to W. T. Weber, Jr. and W. T. Weber, III, Trustees, all of those certain tracts or parcels of real estate, together with appurtenant rights, more particularly described in said deed of trust as follows:
“ITEM ONE
“That certain tract or parcel of real estate heretofore conveyed to Aaron Lowell James and Jenna M. James, his wife, by Lance W. Hines, by deed dated April 8, 2019, to be placed of record in the office of the Clerk of the County Commission of Braxton County, West Virginia, prior to or contemporaneously with the recording of this trust deed, in which said deed said tract or parcel of real estate is more particularly bounded, described and conveyed as follows, viz:
“…the following tract or parcel of land situate in Birch District, Braxton County, West Virginia, and being more particularly bounded and described as follows:
BEGINNING at a black walnut in the edge of the county road, and in original line, thence through whole tract, S. 60 ½ E. 51 poles to a small dogwood near the top of the hill, N. 37 E. 22 poles to a stake in said line, and with original line, N. 47 ½ W. 52 poles to a stake in said line, and with original line and county road, S. 37 ½ W. 35 ½ poles to the place of beginning, containing 9 ¾ acres, more or less.”
“In the deed aforesaid to Grantors the following reservations, exceptions, limitations and conditions, subject to which this trust deed is made, appear and are hereinafter set out as follows, viz:
“It is further understood and agreed by and between the parties hereto that the grant herein contained is made subject to all reservations, exceptions, limitations, conditions, rights of way or easements, and other servitudes, if any, made, retained or otherwise created by the deeds or other instruments constituting the record chain of title to the real estate herein and hereby conveyed.”
“ITEM TWO
That certain 20.18 acre, more or less, residual tract or parcel of real estate heretofore conveyed to Aaron L. James by Lowell A. James and Donna Jane James, by deed dated August 29, 2018, of record in said Clerk’s office in Deed Book 628, at page 48, in which said deed said tract or parcel of real estate is more particularly bounded, described and conveyed as follows, viz:
“…the following described real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate on the waters of Leatherwood Run, a north tributary of Big Birch River, in Birch District, Braxton County, West Virginia, and more particularly bounded and described as follows:
“BEGINNING at a stake, a corner to lands formerly owned by Peter Hamrick’s heirs, and with a line of this land, reversed, N. 52 W. 116 poles to a stake and pointers; thence S. 35 W. 78 poles to a stake; thence S. 39 E. 104 poles to a Sycamore on the original line of the Peter Hamrick land, and with said line, reversed, N. 60 E. 52 poles to a beech; thence N. 33 E. 44 poles to the place of beginning, containing sixty (60) acres, more or less.”
“And being the residue of a tract of sixty (60) acres which was conveyed by Homer Bail and Lettie Bail, his wife, to Alton D. James and Faye James, his wife, by deed dated the 27th day of February 1959, which deed is of record in the Office of the Clerk of the County Commission of Braxton County, West Virginia in Deed Book 268, at Page 112.
“After that conveyance to Alton D. James and Faye James, his wife, there were three (3) conveyances to Lowell A. James and Donna Jane James, his wife, by Mary Faye James, widow, also known as Faye James, those conveyances being as follows:
- A tract of 2.60 acres by deed dated the 2nd day of September, 1981, which deed is of record in the aforesaid Clerk’s Office in Deed Book 389, at Page 694;
- A tract of 10.00 acres by deed dated the 6th day of July 1983, which deed is of record in the aforesaid Clerk’s Office in Deed Book 403, at Page 177;
- A tract stated to be 47 acres, which was the residue of the tract of 60 acres by deed dated the 30th day of October 1991, which deed is of record in the aforesaid Clerk’s Office in Deed Book 467, at Page 307.
Due to the aforesaid three (3) conveyances into Lowell A. James and Donna Jane James, his wife, they then held ownership of the original sixty (60) acres tract.
- By deed dated the 7th day of August 2015, of record in the aforesaid Clerk’s Office in Deed Book 607, at Page 405, Lowell A. James and Donna Jane James, his wife, conveyed to Gregory Matthew Nettles a tract of 39.82 acres, which was stated to be composed of all of the 2.60 acres, all of the 10 acres, and 27.22 acres of the 47 acres residue tract of the original sixty (60) acres tract, thereby leaving by subtraction being conveyed in this deed a tract stated to contain 20.18 acres.”
The real property hereinbefore described was conveyed as aforesaid to secure the Citizens Bank of Weston, Inc., in the payment of that certain note recited and described in said deed of trust, and all amendments, replacements or renewals thereof, and which said notes, and/or renewals and/or replacements thereof, being long since due and payable, and default having been made in the payment thereof, the undersigned Trustee, having been requested so to do, will, on the 5th day of November, 2025, at 10:00 a.m. at the front door of the Courthouse of Braxton County, in the City of Sutton, Braxton County, West Virginia, sell to the highest and best bidder, for cash in hand on day of sale, the hereinbefore described real estate. The deed which will be delivered by said Trustee at the time of sale will be made subject to such exceptions, reservations, limitations, conditions, rights of way, easements and other servitudes, if any, contained in the chain of title to the real estate aforesaid and subject to all unpaid ad valorem taxes.
