NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE and Notice of the Beneficiary/Servicer’s election to sell that property secured by that certain Deed of Trust dated January 13, 2006, executed by David M. Blankenship to Charles S. Trump and/or George I. McVey, Trustees, of record in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Book 1514, at Page 613, which Deed of Trust was assigned by Mortgage Electronic Registration Systems, Inc. to The Huntington National Bank by ASSIGNMENT dated April 6, 2015, of record in the Clerk’s Office in Book 187, at Page 338. Hereford & Riccardi, PLLC was appointed as Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 27, 2015, of record in the Clerk’s Office in Book 1157, at Page 540. The borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Jefferson County, in Charles Town, West Virginia, on:

MONDAY, JULY 6, 2015, AT 10:15 O’CLOCK A.M.

All of that certain lot or parcel of real estate, together with the improvements thereon and appurtenances thereunto belonging, situate in Harpers Ferry District, Jefferson County, West Virginia, more particularly described as follows:

Beginning at (A) an iron peg a corner to Tract “A” of land of Moler et al on the northwest side of a 12 foot right-of-way and in the line of the land of Martin; thence with Tract “A” S. 65° 23’ 11” E. 261.70 feet to (B) an iron peg a corner to Tract “A” in the line of the land of Shuff; thence with the land of Shuff S. 27° 37’ 14” W. 54.27 feet to (3) an iron peg in the line of Shuff and a corner to the land of Kidwiler; thence with the land of Kidwiler for the following two courses: N. 66° 30’ 47” W. 124.59 feet to (4) a metal fence post in a concrete wall; thence N. 64° 38’ 53” W. 136.29 feet to (5) an iron peg corner to Kidwiler in Martin’s line and on the northwest side of a 12 foot right-of-way; thence with the 12 foot right-of-way and the land of Martin N. 26° 41’ 03” E. 54.93 feet to the point of beginning; containing 14,525 square feet, more or less; together with a non-exclusive easement or right-of-way for access to and from said land and the public road (W.Va. Sec. Rte. No. 30/1) over the presently existing roads 12 feet wide extending northwardly across the westernmost part of Tract A, and westwardly from Tract A to the public road.

Conveyance is subject to a right-of-way 12 feet wide across the westernmost part of the real estate conveyed for the benefit of the property lying to the south of the real estate conveyed; and subject, also, to utility easements of record.

This is the same property conveyed unto David M. Blankenship by deed dated January 13, 2006, of record in the Clerk’s Office in Book 1018, at Page 558.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-2.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee by cashier’s check, cash or the equivalent within thirty (30) days of the date of sale, with ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale by cashier’s check, cash or the equivalent.
