The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 20, 2020, and duly recorded in the Office of the Clerk of the County Commission of Monroe County, West Virginia, in Deed of Trust Book 286, at Page 620, Alan W. Adkins, Sr. and Holly Adkins did convey unto Rick Dorsey, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Monroe County Courthouse, in Union, West Virginia, on
December 12, 2025, at 1:45 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Sweet Springs District, Monroe County, West Virginia, and more particularly described as follows:
Situate, lying and being in Sweet Springs District, County of Monroe, State of West Virginia, and being more particularly bounded and described as follows:
That certain lot, tract or parcel of real mute, being more particularly designated and described as Lot Number Twenty Two (22), of Mountain View Acres Subdivision, as shown on a map or plat of said subdivision which is recorded in the Office of the Clerk of the County Commission of Monroe County, West Virginia, in Survey Book 7, at Page 101.
Subject to the following restrictive covenants as to the use of the said property, which are imposed for the benefit of, and may be enforced by the Grantor and by his Successors in Interest and Assigns, and by any other party who may now own or hereafter acquire property within said subdivision, to-wit:
- These Lots shall be used for residential or agricultural purposes only, and no business of any kind shall be operated upon said property.
- No residence shall be erected or allowed to remain upon these lots which does not have finished value, as appraised by competent appraisers, of at least $20,000.00 value as adjusted to the building costs of September 1, 1977.
- No single-width mobile home shall be permitted upon these lots.
- Junk cars and similar refuse shall not be stored or allowed to remian on these lots, and no sign or billboard shall be no larger than four feet square.
- No lot shall be further subdivided.
- The exteriors of all residences built upon these lots shall be completed prior to occupancy.
Subject to any and all exceptions, reservations, restrictions, limitations, out-conveyances, rights-of-way, easements, covenants and conditions as may be set forth and contained in any prior deeds or other instruments in the grantors chain of title to said real estate, reference to which is hereby made for all such matters pertaining to the real estate hereby conveyed and for a more particular description of the property.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 125 Mountain View Acres Road, Gap Mills, WV 24941.
AND BEING the same real estate which was conveyed to Alan W. Adkins, Sr. and Holly Adkins, by Deed dated May 16, 2018, from Wesley P. Galford and Kimberly M. Galford, and recorded in the Office of the Clerk of the County Commission of Monroe County, West Virginia, in Deed Book 292, at Page 575.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.`
