NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated July 9, 2008, from Virgie R. Ferguson to William S. Winfrey, II, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1145, at page 776, as modified by the instrument, dated August 19, 2013, of record in said Clerk’s Office in Trust Deed Book 1264, at page 269, the undersigned trustee will offer for sale at public auction on June 5, 2018, at 10:00 a.m. at the front door of 307 Federal Street, Bluefield, West Virginia, all that certain tract or parcel of real estate designated as 0.41 acre, more or less on a map bearing the legend “MAP SHOWING A DIVISION OF THE HELEN WADE PROPERTY AS DESCRIBED IN DEED BOOK 298 PAGE 157 AND DEED BOOK 525 PAGE 303, NEAR KEGLEY, ROCK DISTRICT, MERCER COUNTY, WEST VIRGINIA NASH LAND SURVEYING SOUTH SECOND ST. PRINCETON, WV, 24740 PHONE 304-425-3682 SCALE: 1″ = 30′ DATED 4-2-91 JOB NUMBER: 9101 REVISIONS: DRAWN BY: TSN CHECKED BY:” said plat recorded in the office of the Clerk of the County Commission of Mercer County, West Virginia, as Microfilm Plat No. 10622, and more particularly bounded and described as follows:

BEGINNING at a fence post found in the northern right of way of County Route 19/14, Kegley Road, corner to Robert Lawrence; thence leaving said road right-of-way and along Lawrence and along a fence, N. 19o 30′ 00″ W. 148.84 feet to a 1/2″ rebar set between two corner fence posts, corner to Lawrence and Edward Davis; thence leaving Lawrence and along Davis and along a fence, N. 48o 10′ 44″ E. Passing a 3/4″ rebar in the fence line (set) at 100.00 feet, in all, 125.00 feet to a 3/4″ rebar set in the Davis line and in the fence line; thence leaving Davis and the fence, through the Helen Wade Property, S. 12o 43′ 28″ E. 200.78 feet to a 3/4″ rebar set in the northern right of way of County Route 19/14 and in a fence line; thence along the northern right of way of said County Road and along the fence line, S. 72o 24′ 34″ W. passing a 3/4″ rebar in the fence (set) at 25.00 feet, in all, 92.00 feet to the point of BEGINNING, and containing 0.41 acre, more or less.

And being the same property conveyed to Virgie R. Ferguson by Braveheart Real Estate, Inc., by Deed dated July 8, 2008, to be recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia, simultaneously with this instrument.

There is expressly excepted and reserved from this conveyance rights of others in and to the continued and uninterrupted flow from the underground culvert and open ditch as shown upon said plat and overhead utility easements as shown upon said plat.

This conveyance is subject to all easements, reservations, restrictions, conditions or covenants that are of record in the Clerk’s Office to the extent that the same may lawfully apply to the property herein conveyed.

The deed of trust states that the address of this real estate is HC 78 Box 8 (Trustle Road), Kegley, West Virginia.

J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated December 30, 2013, of record in said Clerk’s Office in Trust Deed Book 1353, at page 799.

This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.

TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by special warranty deed. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
