NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 25, 2005, executed by Borrowers, Larry Rush and Nancy C Hunter, to Mike Raber, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 3232, at Page 417. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 906 6th Street, Charleston, WV 25302. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 3, 2021, of record in the Clerk's Office in Book 4486, Page 798. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 24th day of April, 2026 at 11:20 a.m. Situated in Charleston, Kanawha County, State of WV and being described as follows: All that certain piece or parcel of land, together with the improvements thereon and the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, and being more particularly designated and described as the upper twenty (20) feet of Lot 28 and the lower twenty (20) feet of Lot 29 of Block 27 of Glenwood Addition to West Charleston, as shown upon a map of the same of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 2 at page 8, said parcel of land being more particularly bounded and described as follows: Beginning at a stake on the Northerly side of Sixth Street, which is eighty (80) feet in a Westerly direction from the intersection of said Sixth Street with Glenwood Avenue; thence in a direction towards the hills, with a line parallel to the line of said Glenwood Avenue, one hundred and twenty (120) feet to a stake in the line of an alley; thence with said alley in a Westerly direction forty (40) feet to a stake; thence with a line parallel to said first mentioned line, in a direction towards the Kanawha River, one hundred and twenty (120) feet to a stake in the Northerly line of Sixth Street; thence with the Northerly line of said Sixth Street, in an Easterly direction forty (40) feet to the place of and being the same property granted and conveyed to Charles A. Litton and Helen Litton, his wife, by two deed from Maxie K. Minotti, the first deed bearing date May 16, 1988, and of record in the aforesaid Clerk's Office in Deed Book 2206 at Page 889, and the second deed being a corrective deed bearing even date wherewith, of record in the aforesaid Clerk's Office in Deed Book 2284 at Page 328, and reference is hereby made to said map and deeds for a more particular description of the property herein conveyed. The above legal description being the same as the last deed of record, no boundary survey having been made at the time of this conveyance. BEING the same property conveyed to Prince A. Hunter and Nancy A. Hunter, his wife, and Larry Rush, as Joint tenants with right of survivorship and not as tenants in common, by deed from Charles A. Litton and Helen Litton, his wife, dated 12/16/91, recorded 12/16/91, in Book 2284, page 331, in the Office of the Clerk of the County Commission of Kanawha County, WV. Prince A. Hunter died on 8/25/00, by operation of law, title solely vested in Nancy C. Hunter and Larry Rush. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Pursuant to the Financial Crimes Enforcement Network's Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements. 7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
