NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated September 5, 2017, executed by Borrower(s), Niki ODaniel, to Andrew C. Skinner, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4261, at Page 677. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5134 Saulton Dr, Cross Lanes, WV 25313. Smith died on November 14, 2011, and by virtue of manner in which title was held Benjamin L. Smith, became the owner of said property herein conveyed. Said Benjamin L. Smith died testate on June 23, 2016, and devised the subject property to Benjamin L. Smith Jr. and Jeffery H. Smith, by will recorded in the aforesaid Clerk's office in Will Book 901, at Page 770. Smith tract; thence S. 63 55' E. 38.8 feet to an iron pipe; thence S. 9 46' W. 206.26 feet to an iron pipe; thence N. 88 10' W. 109.3 feet to an old iron pipe; thence N 25 58' E. 241.3 feet to an iron axle, the place of beginning, and being Plot No. 3 as shown on a map entitled "A Plot of Land in Union District, Kanawha Co., West Va., owned by H. Sherman and Marie Saul ton to be conveyed to Benjamin L. & Juanita P. Smith, dated 9-25-72 by Wm. T. Watts, L.L.S." which map is attached hereto and made a part hereof. And being the same property conveyed unto Benjamin L. Smith and Juanita P. Smith from Della A. Saulton, Hobart S. Saulton, and Wilma Saulton, by Deed dated November 9, 1972, of record in the aforementioned Clerk's Office in Deed Book 1683, at page 680. The said Juanita P. Smith died on November 14, 2011 , and by virtue of manner in which title was held Benjamin L. Smith, became the owner of said property herein conveyed. Said Benjamin L. Smith died testate on June 23, 2016, and devised the subject property to Benjamin L. Smith Jr. and Jeffery H. Smith, by will recorded in the aforesaid Clerk's office in Will Book 901, at Page 770. The said parties of the first part do hereby grant and convey unto the parties of the second part, an easement and right of way over and along the right of way 27.40 feet wide to the immediate north of the property hereby conveyed, as well as over and along the 30 foot street leading from said right of way to Ridge Road. It is covenanted and agreed that the parties of the first part shall reserve the fee in said right of ways as shown upon said map, and that the parties of the second part shall have the right to use the same for ingress and egress to Ridge Road, in common with The other owners of other property located in said subdivision.
