NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated November 9, 2022, executed by Borrower(s), Annie Gallagher and Barbara Springer, to Chris Eller, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4618, at Page 280. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1406 Lee St E, Charleston, WV 25301. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 26, 2025. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date: 7th day of November, 2025 at 11:30 a.m. All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Charleston East Tax District, Kanawha County, West Virginia, and being known and designated as a part of Lot No. Twenty-One (21) of the James B. Noyes Addition, as shown upon a map of the same, filed and of record in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Photostatic Map Book 1, at page 37, and being more particularly bounded and described as follows: Beginning at an iron pin located at the intersection of the northern line of Shelton Avenue with the eastern line of Lee Street; thence along the eastern line of Lee Street, N. 44 35" W. 37.15 feet to a nail located at the front common corner of the property hereby conveyed and the property now or formerly owned by J.T. Moore; thence with the dividing line between said properties, N. 42 30' E. 44.75 feet to an iron pin, being the rear common corner of the property hereby conveyed and the Moore property; thence leaving said division line and running with the division line between Lots Nos. 21 and 22 of the James B. Noyes Addition, S. 44 30" E. 36. 72 feet to an iron pin located in the northern line of Shelton Avenue; thence along the northern line of Shelton Avenue, S. 41 57' W. 44.7 feet to the place of beginning, as shown upon a map entitled, "Map Showing Part of Lot 21, James B. Noyes Addition, Charleston, W.Va., Survey for Junius T. Moore, Sr.", dated November 12, 1958, made by James Sell, C.E., and recorded in said Clerk's office in Deed Book 1262, at page 394-A. And being a part of the same property conveyed unto Jia Hao Tue Yuan, LLC by R.A.C. Inc., by Deed dated October 26, 2011, and of record in the aforesaid Clerk's Office in Deed Book 2805, at page 659. This conveyance is made subject to the right-of-way for sewer and the restrictions contained in the deed from Nora Cavin, et. al. to Elizabeth Shaefer, dated September 24, 1914, and recorded in the aforesaid Clerk's office in Deed Book 147, at page 468. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
