NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated May 3, 2023, executed by Borrower(s), Shaeonna Jackson, to David G. Palmer, the Trustee of record in the office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2922, at Page 563. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3712 Riverside Dr, Huntington, WV 25705. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 10, 2026, of record in the Clerk's Office in Book 427, Page 405. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. PARCEL TWO: All that certain piece or parcel of land situate in the City of Huntington, County of Cabell, State of West Virginia, being a part of the south end of that piece of land which is known as Lot 18 of Block 24 of Altizer Place, as shown on the Revised Map of the Cole and Crane Plat of Altizer Place, said map being recorded in Deed Book 180, at page 358, in the Office of the Clerk of the County Commission of Cabell County, West Virginia, and said parcel being more particularly described as follows: BEGINNING at a point in the north right of way line of Riverside Drive, said point being the south corner common to Lot 17 and Lot 18; Thence, from said beginning, and coursing into said Lot 18, N. 64 46' W. 22.73 feet; Thence, N. 25 56' W. 85.40 feet to a point in the east right of way line of Elm Street; Thence, with said east right of way line, N. 5 06' W. 20.95 feet to a point in the south line of the property of Florence Honaker (Will Book 57, at page 230); Thence, with said south line, N. 84 54' E. 50.00 feet to a point in the line between said Lot 18 and said Lot 17; Thence, with said lot line, S. 5 06' E. 112.25 feet to the BEGINNING, and containing 3,939 square feet. PARCEL THREE: All that certain lot, piece or parcel of ground situate in Cabell County, West Virginia, being a part of the tract or lot designated on the Revised Map of Cole & Crane Plat of Altizer Place, a copy of which map of recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, on February 12, 1921, in Deed Book 180, at Page 358, as LOT NO. EIGHTEEN (18), in BLOCK NO. TWENTY-FOUR (24), EXCEPTING AND RESERVING, therefrom the Southerly portion of said Lot No. 18 previously conveyed by Florence Honaker to Inco Alloys International, Inc., by deed dated September 2, 1988, recorded in the aforesaid Clerk's Office in Deed Book 901, at Page 282, said outconveyance being more particularly described as follows: BEGINNING at the Southwest corner of said Lot, being the intersection of the Easterly line of Elm Street and the Northerly line of Riverside Avenue; thence Easterly along the Northerly line of Riverside Avenue, 50.05' to the Easterly line of said Lot 18; thence Northerly following said lot line, 112.25' to a point; thence westerly 50.05' perpendicular to the Westerly line of said lot; thence Southerly along the Easterly line of Elm Street, 110 feet to the place of BEGINNING. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Pursuant to the Financial Crimes Enforcement Network's Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention.
