NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 16, 2023, executed by Borrower(s), Jennifer Rebecca Muslin, to Douglas B. Ernest and Charles J. Mildren, the Trustee of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Book 4647, at Page 150. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 219 2nd St N, Saint Albans, WV 25177. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated March 5, 2026, of record in the Clerk's Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Kanawha County, in Charleston, West Virginia, on the following date:24th day of April, 2026 at 11:40 a.m. All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Jefferson District, Kanawha County, West Virginia, being all of Lot Four (4) of the Resubdivision of Lots One Hundred Ninety-Seven (197), One Hundred Ninety-Eight (198), Two Hundred Thirty-One (231), and Two Hundred Thirty-Two (232), of Marlaing Addition to St. Albans, West Virginia, as the said Lot Four (4), is shown upon a plat thereof dated August, 1949, and recorded with the deed from Title Mortgage and Discount Company, a corporation, to Clarence A. Kinder and Virginia Lee Kinder, his wife, dated April 18, 1950, and of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 909, at Page 239, the map of said Marlaing Addition being also of record in the aforesaid Clerk's office in Photostatic Map Book 10, at page 92; And being the same property conveyed to Kenneth E. Tyree, Jr., and Leona E. Tyree by Deed dated April 24, 1997, from Anne B. Charnock of record in the aforesaid Clerk's office in Deed Book 2410 at page 726. The said parties of the first part do further GRANT AND CONVEY unto the party of the second part all of their interest in the right to use the sewer line extending across the rear of the said Lot Four (4), and across the rear of other lots in the Resubdivision, and other sewer lines in said Subdivision. This conveyance is made subject to the burden of the reservation of right to use the said sewer line by the said Title, Mortgage and Discount Company, for the benefit of all lots in said Subdivision and the burden of joint maintenance thereof. This conveyance is specifically subject to the covenants and restrictions recited and contained in that certain deed from Title, Mortgage and Discount Company to Clarence A. Kinder and Virginia Lee Kinder, his wife, of record in the aforesaid Clerk's office in Deed Book 909, at page 239. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.6) Pursuant to the Financial Crimes Enforcement Network's Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention.
