NOTICE OF TRUSTEE’S SALE

NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated January 14, 2008, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5030 at page 1661, executed by Jack L. Bishop and Kathy M. Bishop to Alan R. Terry and Carl W. Roop, Trustees, securing Pioneer Community Bank, which was given to secure the payment of the note therein described, and demand having been made upon the undersigned so to do, the undersigned Trustee, Carl W. Roop will, on the 18th day of October, 2019, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 8:45 a.m., sell the property hereinafter described, which property was conveyed in said Deed of Trust, and being more particularly described as follows:
The surface of the following described tract of land located in the unincorporated town of MacArthur, Town District, Raleigh County, West Virginia, and being more particularly described as follows:
Being parts of Lots 5 and 6 of the Bethel Addition to MacArthur, Town District, Raleigh County, West Virginia, as shown on a map recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, on June 23, 1953, said map entitled, “Bethel Addition to MacArthur, Raleigh County, West Virginia, Scale 1″ = 50 feet, P. H. Wilson, C. E., March 7, 1953,” and being of record in Map Book 9, at page 121, which said parcels of land being described as follows:
BEGINNING at a stake in the line of Lot No. 4, Bethel Addition, a corner to Lots Nos. 5 and 10; thence with line between Lots Nos. 4 and 5, S. 52deg. 42′ E. 111.53 feet to a stake on the west right of way line of W.Va. Route No. 16, a corner of Lots Nos. 4 and 5; thence with said right of way line and across fronts of Lots Nos. 5 and 6, N. 39deg. 31′ E. 91.72 feet to a stake; in a one-foot reservation line, a corner to Lot No. 6; thence with reservation line N. 38deg. 59′ W. 88.46 feet to a stake; thence through Lots Nos. 5 and 6, in a southwestern direction 116.36 feet back to the point of beginning.

And being the same property conveyed to Jack L. Bishop and Kathy M. Bishop, his wife, by deed dated the 9th day of January, 2001 from Ellen Rhodes, single, which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia as Instrument No. 5003, at Page 9533.
There is EXCEPTED AND RESERVED from the above conveyance the portion of the property taken by The State Road Commission of West Virginia by Court Order dated February 3, 1986, of record in the aforesaid Clerk’s office in Deed Book 447, at page 86.
Said property will be sold upon the following terms and conditions:
1. Cash in hand on day of sale.
2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property.
6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property.
7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
