NOTICE OF TRUSTEE’S SALE
NOTICE is hereby given that default having been made under the terms of a Deed of Trust dated November 29, 2013, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5054 at page 4845, executed by William M. White to Robert L. Milam, Jr. and Brian Abraham, Trustees, securing Whitesville State Bank, which was given to secure the payment of the note therein described, and by Substitution of Trustee of record in the aforesaid Clerk’s office in Book 5070 at Page 4498 and demand having been made upon the undersigned so to do, the undersigned Substitute Trustee, Carl W. Roop will, on the 13th day of November, 2019, at the front door of the Raleigh County Courthouse, in the City of Beckley, West Virginia, at 8:30 a.m., sell the surface only of all that certain tract or parcel of land, situate, lying and being known as Walhonde Village, in Clear Fork District, in Raleigh County, West Virginia, together with a 1995/96 – 28 x 70 Norris Manufactured Home, and more particularly described as follows:
BEING LOT 12 of Parcel of 1 of said Walhonde Village as shown and laid down upon a map thereof recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Files 149A and 150A, said property being more particularly described in said map.

The said parties of the first part do hereby EXCEPT and RESERVE for themselves, their heirs, their successors and/or their assigns in title an easement and right-of-way across and through Lot 12, for the purposes of ingress, egress, and customary utilities to Lot 11. Said easement and right-of-way being six (6) feet in width with the centerline of same marked by a stake.
This conveyance is made subject to the “Declaration of Covenants, Conditions, Restrictions and Easement with the Walhonde Village Homeowner’s Association, Incorporated”, dated June 18, 1979, and recorded in said Clerk’s Office in Deed Book 614, at page 441, and also to the easement agreements and rights-of-way set forth in that Deed dated January 28, 2004, and recorded in Deed Book 5012, at page 3382, and December 4, 2007, and recorded in Deed Book 5029, at page 6807.
And being part of the same property conveyed to William M. White by a Deed dated June 7, 2011, from Darrell L. Duncan and Brenda K. Duncan, which Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5043, at page 6691.
Said property will be sold upon the following terms and conditions:
1. Cash in hand on day of sale.
2. The property will be conveyed in an “AS IS” condition by Deed containing Special Warranty of Title, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, validly enforceable prior liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Substitute Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Substitute Trustee.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, or remove any personal property and/or belongings remaining at the property.
6. The purchaser(s) at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property.
7. In the event there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
