NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated January 6, 2015, executed by Michael D. Durham and Denise E. Stump to Gary R. Mills and Stephen M. Feola, Trustees, of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Trust Deed Book 5057, at page 5471, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee of record in the aforesaid Clerk’s office in Trust Deed Book 5070, at page 6436, default having occurred in payment of the indebtedness secured by said Deed of Trust, and the undersigned substitute trustee having been requested to do so by First Community Bank, owner and holder of the indebtedness secured by said Deed of Trust, the undersigned substitute trustee will offer for sale and sell at public auction on January 3, 2020, at 11:00 a.m., at the front entrance to the Raleigh County Courthouse, 215 Main Street, Beckley, Raleigh County, West Virginia, the following described real estate, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:
PARCEL ONE:
That tract or parcel of land, together with any appurtenances thereunto belonging, located in Robertson Addition to the City of Beckley, Raleigh County, West Virginia, said tract having been previously identified as TRACT NO. ONE in prior Deeds, and being more particularly described as follows:
Being a part of what is now known as Lots Nos. 53, 54, and 55 (originally known as Lots Nos. 12, 13, and 14) of the Robertson Addition to the City of Beckley, Raleigh County, West Virginia, and being more particularly described on a map which was attached to that Deed recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5048, at page 0057, which map is made a part of this deed for all purposes of description, and which map is identified as “PLAT SHOWING BOUNDARY SURVEY OF THREE TRACTS OWNED BY ALTA KINCAID SITUATED IN ROBERTSON ADDITION CITY OF BECKLEY, RALEIGH COUNTY WEST VIRGINIA SCALE: 1” = 30′ “, and prepared by Eastern Surveying, Inc., and dated February 2, 2002, with TRACT NO. ONE identified on said map as “4,286 S.F. = 0.098 ACRE”, and reference is made to said map for a more particular description of the property hereby conveyed.

PARCEL TWO:
The surface of those two (2) certain tracts or parcels of land, together with all improvements thereon and appurtenances thereunto belonging, situate in the City of Beckley, Town District, Raleigh County, West Virginia, and more particularly bounded and described as follows:
FIRST: Lots Nos. 5, 6, and 7 of Block “I” in the Poplar Addition to the said City of Beckley.

And all of the aforesaid three lots being more particularly shown and designated upon a map thereof entitled “Poplar Addition, Map of Blocks “G”, “I” and “J” of the Robertson’ Addition to the City of Beckley, see map recorded in the Raleigh County Courthouse in Map Book No. 1, at Page 183 as laid out by Louis Briguglio, Scale 1″ = 80′, J.A. Graft, Engineer, Beckley, West Virginia,” a copy of which said map is on file in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book No. 3 at Page 40, to which map reference is hereby made for a more particular description of the property herein conveyed.

SECOND: Those certain tracts or parcels of land situate and lying in said Block “I” in the said Poplar Addition and bordering on the rear of said Lots Nos. 5, 6, and 7 of Block “I” and more particularly designated as Tract 5-A, being on the rear of said Lot 5, Tract No. 6-A being on the rear of said Lot 6, and Tract No. 7-A being on the rear of said Lot No. 7: each of the aforesaid three tracts, to-wit: Tract No. 5-A, Tract No. 6-A, and Tract No. 7-A. being 71/2 feet in width.

All of the aforesaid parcels designated as Tract 5-A. 6-A. and 7-A of Block “I”, are shown upon a map of the Poplar Addition entitled “Map of Poplar Addition showing abandonment of 15-foot alley, Scale 1″=50′ — March 20, 1951, Dennis M. Leary, Jr., consulting Engineer, Beckley, West Virginia, March 11, 1951.” a copy of which said map is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, together with a Deed from the City of Beckley to Josephine Vecellio, to which map references is here made for a more particular description of the tracts and parcels herein conveyed.

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned Trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
