NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 17, 2011, executed by Borrowers, Jim Hayworth and Sue Hayworth, to George M. Schoen, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5042, at Page 6473. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 114 Bridge Court, Dry Creek, WV 25062. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated October 3, 2017, of record in the Clerk’s Office in Book 5066, Page 2832. The borrowers defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:
26th day of April, 2019
at 11:30 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Marsh Fork District, Raleigh County, West Virginia, and being more particularly described as follows:

All of those certain lots, together with the improvements thereon and the appurtenances thereunto belonging, of that certain property located in Marsh Fork District, Raleigh County, West Virginia, more particularly bounded and described as follows:
TRACT NO. 1
The surface of those certain lots or parcels of land situate in Marsh Fork District, Raleigh county, West Virginia, in Marsh Fork District, Raleigh County, West Virginia, on the waters of Dry Creek, a tributary to Big Coal river and 0.4 miles northeast of West Virginia Route 3 of the West Virginia Secondary 3/6, and being Lots 8 and 9 of the Bob Clay Subdivision as shown and designated upon a map of the said Bob Clay Subdivision of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map File 296/B, to which said map reference is here made and made a part hereof for a more particular description of the said lots herein conveyed.

Beginning at a set 5/8″ roof bolt a common corner to lots #17 and 18 and on the south right of way line of the road through the Bob Clay Subdivision Addition 2; thence with said right of way line N 49deg. 36′ E 14.73′ to a found 1/2″ iron pipe a common corner to lots #18 and 8; thence leaving the right of way line and with the property line of lots #18 and 8 S 45deg. 00′ E 125.00′ to a found 1/2″ iron pipe a common corner to lots #18 and 8and an interior corner to Clay property; thence leaving Lot #8 and with the interior line of Clay property S 49deg. 36″ W 73′ to a set 5/8″ roof bolt a corner to lots #17 and 18; thence with lot #17 S 45deg. 00″ E 125.00′ to the place of beginning as surveyed May 1984 by deChandelle Const & Survey Co., Inc. P.O. Box 127; Bloomingtose, WV 25024

Being the same property conveyed to Jim Hayworth and Sue Hayworth by the Deed dated August 5, 1999 and recorded in Deed Book 5000 at Page 5720 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
