NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated March 25, 2015, executed by Borrower, James David Miller, to Alan H. Larrick, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5058, at Page 2198 and a Corrective Deed of Trust dated March 25, 2015 and recorded in Deed of Trust Book 5058, Page 3775. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1571 Old Bryson Road, Lester, WV 25865. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 11, 2019, of record in the Clerk’s Office in Book 5069, Page 0790. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:
29th day of January, 2020
at 1:30 p.m.

The surface of that certain real estate located in TRAP HILL DISTRICT, RALEIGH COUNTY, WEST VIRGINIA, and more particularly described as follows:

BEGINNING at a set stone, said stone being a corner of said Blaine C. Bailey and Tract No. 1; thence continuing with the common line between said Bailey and Tract No. 1 N 15deg. 37′ 04″ W 330.73 feet to a post on the previously mentioned right-of-way line; thence leaving Bailey and with said right-of-way line the following 4 calls: N 38deg. 50′ E 55.80 feet to a point; N 47deg. 00′ E 37.79 feet to a point; N 76deg. 05′ E 135.47 feet to a point: S 85deg. 19′ E 87.70 feet to an iron pin; S 12deg. 24′ 42″ E. 277.54 feet to a post at the end of a fence; thence with the fence S 60deg. 35′ 28″ W 289.44 feet to the point of BEGINNING and containing 2.21 acre more or less, as shown on a map recorded in Deed Roll 59, at page 358.

Being the same property conveyed to James David Miller by the Deed dated February 27, 2015 and recorded in Deed Book 5058 at Page 2197 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
