NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 21, 2010, executed by Borrower(s), Dolly E Nix and Gregory R Nix, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1191, at Page 84. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1201 Castlewood Lane, Bluefield, WV 24701. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 6, 2018, of record in the Clerk’s Office in Book 1350, Page 100. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Bluefield District, Mercer County, West Virginia, and being more particularly described as follows:

All that certain tract or parcel of real estate, together with the improvements thereon and easements and appurtenances thereunto belonging, situate in the City of Bluefield, Mercer County, West Virginia, known as Lots 11 and 12, Section 1308 (formerly Section J) of the Cumberland Heights Addition, which property is more particularly bounded and described as follows:

Lot 11: Beginning at a point in the easterly line of Cliffmont Avenue, which point is located by the two following courses and distances from the point of intersection of the eastern line of Cliffmont Avenue and the southern line of Heatherwood Road (formerly Cumberland Boulevard): S. 37 degrees 17′ E. 530 feet to a point; thence S. 24 degrees 17′ E. 216 feet to said beginning point, which point is also the southwest corner of Lot 10 in said Section; thence from said beginning point and along and with the southern line of Lot 10, N. 52 degrees 40′ E. 185 feet to a point in the western line of Castlewood Drive, which point is also the southeast corner of Lot 10; thence along and with the western line of Castlewood Drive, S. 17 degrees 17′ E. 75 feet to a point, which point is also the northeast corner of Lot 12 in said Section; thence along and with the northern line of Lot 12, S. 52 degrees 40 W. 185 feet to a point in the eastern line of Cliffmont Avenue, which point is also the northwest corner of Lot 12; thence with the eastern line of Cliffmont Avenue, N. 17 degrees 17′ W. 75 feet to the point of beginning.

Being the same property conveyed to Dolly E Nix and Gregory R Nix by the Deed dated June 10, 2010 and recorded in Deed Book 951 at Page 135 in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
