NOTICE OF TRUSTEE’S SALE – PUBLIC AUCTION

NOTICE OF TRUSTEE’S SALE PUBLIC AUCTION In execution of a certain Deed of Trust dated May 8, 2014, recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Trust Deed Book 929 at Page 747, default having been made in the payment of the obligation thereby secured, and being required by the beneficiary so to do, the undersigned Substitute Trustee, as Substituted by Substitution of Trustee dated March 31, 2015, and of record in Trust Deed Book 948 at Page 34, (who by the authority of the Deed of Trust may act independent of any other Trustee) shall sell at public auction at the front door of the Court House of Fayette County at Fayette County, West Virginia, on Wednesday, August 5, 2015, at 10:00 a.m., the following described tract or parcel, together with the improvements thereon, appurtenances thereunto belonging and rights incident thereto, situate in the Town of Smithers, Fayette County, West Virginia, and being more particularly bounded and described as follows: Situate in Town of Smithers, (formerly Falls District), being Lot 5 in Block D, beginning at a point in the North side of a 25 foot street on the line between Lots 5 and 6 in said block, and running with said dividing line 85 feet to a 10 foot alley; thence with said alley, S 60-32 W 20.7 feet to a 12 foot alley; thence with said 12 foot alley, 85.5 feet to said 25 foot street; thence with said 25 foot street, N 60-32 E 33.8 feet to the beginning. And being the same property conveyed to Evelyn F. Petry by Deed of Frances Dalporto Schmitt, Trustee of the Frances Dalporto Schmitt Revocable Trust dated September 22, 1999. And further being the same tract conveyed in Trust by Evelyn F. Petry by Trust Deed dated May 8, 2014, of record in the aforesaid Commission Clerk’s Office in Trust Deed Book 929 at Page 747. The above described real estate will be conveyed by the undersigned Trustee to the purchaser by Deed conveying with covenant of SPECIAL Warranty and subject to all liens, reservations and exceptions appearing in the record title, and to the lien of all unpaid taxes, if any, which are entitled to priority over the lien of the aforesaid Deed of Trust. The subject property will be sold in AS IS condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. REAL ESTATE TAXES: The subject property will be sold by the undersigned Successor Trustee subject to real estate taxes presently a lien against said subject property. Any purchaser shall purchase subject to, and be responsible for, said real estate taxes. TERMS OF SALE CASH ON DAY OF SALE. The above described real estate will be sold by the undersigned Trustee or his agent and attorney by auction to the highest bidder subject to the right of the Trustee to reject all bids, if, in his opinion, they are inadequate. The owner of the indebtedness secured by the above described Deed of Trust and the owner of any other interests in the property to be sold shall have the right to bid. CONTINUANCE OR ADJOURNMENT OF SALE. The Successor Trustee reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time, without further notice and announcement at the time and place of the sale, as hereinbefore set forth, or any continuance thereof or adjournment thereof.
