NOTICE OF TRUSTEE'S SALE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 14, 2009, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 3450, at Page 731, James L. High and Teresa G. High did convey unto Dan Kennedy and Todd Taylor, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on May 21, 2026, at 6:01 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Charleston District, Kanawha County, West Virginia, and more particularly described as follows: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, lying and being situate in the City of Charleston, Kanawha County, West Virginia, being a part of Lot No. Twenty (20) of the Humphries, Glover and Daugherty addition to the City of Charleston as the same is shown and designated upon a map entitled "Part of Lot No. 20 of the land of Humphries-Glover and Daugherty, "made by field engineering company dated March 20, 1952, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 1043, at Page 148, said property fronting fifty-one (51) feet on the northern side of Vincent Street and more particularly bounded and described as follows: Beginning at a point in the northern line of Vincent Street, which point is located N. 58 degrees 00' E. 69 feet from the intersection of a northern line of Vincent Street with the eastern line of Butler Street, as shown upon the aforesaid map; thence leaving Vincent Street and running through said Lot No. 20, N. 29 degrees 35' W. 22.10 feet to a point; thence N. 59 degrees 23' E. 6.41 feet to a stake; thence N. 25 degrees 40' W. 18.10 feet to an iron pin located in the division line between Lot Nos. 19 and 20, as shown upon the aforesaid map; thence with the division line between said lots, N. 58 degrees 00' E. 13.36 feet to an iron pin in said line; thence leaving said division line, S. 31 degrees 23' E. 5 feet; thence leaving said division line, S. 31 degrees 23' E. 5 feet; thence N. 58 degrees 00' E. 30 feet to an iron pin located in the western line of an alley; thence along the western line of said alley, S. 31 degrees 23' E. 35 feet to a stake, which stake is located at the intersection of said alley with the northern line of Vincent Street; thence along the northern line of Vincent Street, S. 58 degrees 00' W. 51 feet to the place of beginning. High and Teresa G. High, his wife, as joint tenants with the right of survivorship and not as tenants in common. This conveyance is made subject to that certain parcel measuring five (50 feet in width and thirteen (13) feet long which was conveyed to Virginia Shambling from Leary Sue Expertly, widow, by Deed dated June 20, 1972, and of record in said Clerk's Office in Deed Book 1657, at Page 266. Subject to the foregoing and subject to the lien for real property taxes for the year 1988, which said taxes shall be prorated on a calendar year basis as of the date of delivery of this Deed and assumed by the parties of the second part, the party of the first part warrants generally the property hereby conveyed and covenants that same is free and clear of all liens and encumbrances. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 910 Vincent Street, Charleston, WV 25302. AND BEING the same real estate which was conveyed to James L. High and Teresa G. High, by Deed dated March 1, 1998, from Leary Sue Epperly, widow, by her attorney in fact, John M. Epperly, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 2200 at Page 907. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
