NOTICE OF TRUSTEE’S SALE

The undersigned Trustee, by virtue of the authority vested in her by that certain Deed of Trust executed by and between RANDY HOWERTON, (“Borrower”), DAVID L. ZIEGLER and ANNA R. ZIEGLER, (“Trustees”), and DORIS JEAN BAILEY (“Lender’), dated the 20th day of November, 2018, and of record in the Office of the Clerk of the County Court of Mercer County, West Virginia in Trust Deed Book 1364, at Page 304, said Deed of Trust being presently in default, the said Trustee having been requested by the beneficiary thereof so to do, NOW, THEREFORE, I, ANNA R. ZIEGLER, Trustee as aforesaid, will proceed to sell the hereafter described real estate at public auction on the 10th day of July, 2020, at the hour of 10:30 a.m., to the highest bidder for cash in hand at the front door of the Courthouse of Mercer County, West Virginia, which real estate is located in Rock District, Mercer County, West Virginia, and is more particularly described as follows:
BEGINNING at a 5/8″ Rebar set in the western right-of-way of County Route 10/6 (Pocosin Fork Road) and the northeast corner of Gerald Lyle; thence with the northern line of said Lyle N 81deg. – 38′ – 05″ W 143.26′ to a 5/8″ Rebar set at a northwest corner of said Lyle and in the eastern line of Jerry Slemp; thence with the western line of said Slemp N 05deg. – 45′ – 00″ W 300.20′ to a 5/8″ Rebar set at the northeast corner of said Slemp and at southwest corner of Kermit Bailey; thence with the southwestern line of said Bailey S 42deg. – 57′ – 25″ E 212.43′ to a 5/8″ Rebar set at the southeast corner of said Bailey and in western of right-of-way line of said County Route; thence with the western right-of-way line of said County Route the following four calls S 29deg. – 02 – 15″ W 32.93; thence S 17deg. – 44′ – 15″ W 38.83′; thence S 09deg. – 55 – 55″ W 74.30′ thence S 13deg. – 09 – 05” W 97.18′ to the point of BEGINNING, and containing 1.42 acres, more or less, as shown on a plat attached hereto and made a part of this document.

AND BEING part of the same property conveyed unto Doris Jean Bailey from Alma Marie Sowder, a/k/a Marie Sowder, by Keledge B. Lilly, her Attorney-in-Fact by deed dated September 16, 1992, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia in Deed Book 726 at Page 414.

THIS SALE IS MADE subject to such easements, rights of ways, restrictive covenants, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to said real estate.

SAID SALE SHALL BE SUBJECT TO THE FOLLOWING CONDITIONS:
1) Cash or certified funds in hand on day of sale or within 30 days as may be agreed upon by Trustee and Purchaser.
2) Subject to any and all mineral rights and reservations, stipulations, restrictions, reservations, easements, conditions and covenants contained in all former conveyances of the subject property or appearing of record in the aforesaid Clerk’s Office except any pertaining to race, color or creed.
3) Subject to all real estate taxes against said property and any taxes which constitute a lien upon the said property but which are not yet due and payable.
4) The subject property will be sold in AS IS condition. The trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
5) The property will be conveyed by the undersigned Trustee to the purchaser without warranty of any kind, expressed or implied.
6) The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof.
