NOTICE OF TRUSTEE'S SALE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated August 30, 2024, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4709, at Page 807, James W. Smith did convey unto Andrew C. Skinner, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on May 21, 202 at 5:39 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Union District, Kanawha County, West Virginia, and more particularly described as follows: The surface of a certain tract or parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate and lying on the waters of Kelleys Creek, a tributary of Poca River, Union District, Kanawha County, West Virginia, containing two (2) acres, more or less, and being more particularly bounded and described as follows: BEGINNING at 5/8 inch steel pin situated in the outside boundary line of the C.H. Lovejoy 88.45 acre tract, said point being N. 62 12' E. 121.0 feet from the corner of Harold W. Miller .88 acre tract and 99.50 feet from a 17 inch White Oak tree standing on the Lovejoy-Britton line; thence N. 62 12' E., leaving old fence 55 feet and continuing with said line for total distance of 220 feet to a 5/8 inch steel pin set in said common line; thence S. 41 29' E., running through the Lovejoy tract 360 feet to a 5/8 inch steel pin located on the West edge of a 20 foot gas well road; thence S. 52 28' W., with the said gas well road 239.68 feet to a 5/8 inch steel pin located on the edge of said road; thence N. 37 52' W. and running through the Lovejoy tract for a distance of 401.20 feet, more or less, to the place of beginning. The parcel being conveyed is shown upon a plat prepare by Jarrel A. Clendenin, a surveyor, in September of 1983, which I attached hereto and made a part hereof. The Grantors further convey to the Grantee a right-of-way for the purposes of ingress and egress which is shown and delineated upon the plat prepared by Jarrel A. Clendenin and attached hereto the foregoing parcel and right-of-way being a part of an 88.5 acre tract of land conveyed by Dorothy S. Johnson, et ux., to C.H. Lovejoy and Nora B. Lovejoy by deed dated April 5, 1946, and recorded in the aforesaid Clerk's Office in Deed Book 739, at page 360. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 3492 Kelly's Creek Road, Charleston, WV 25312. AND BEING the same real estate which was conveyed to James W. Smith, by Deed dated August 19, 2024, from Ian T. Lovejoy and Tracy D. Lovejoy, and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3208 at Page 98. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
