NOTICE OF TRUSTEE'S SALE The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 25, 2022, and duly recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed of Trust Book 4614, at Page 602 and Deed of Trust Book 4614, at Page 595, Building Appalachia, LLC did convey unto Raymond G. Dodson & Joshua Stowers, Trustees, certain real property described in said Deeds of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Kanawha County Courthouse, in Charleston, West Virginia, on July 7, 2026 at 4:00 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Charleston W District, Kanawha County, West Virginia, and more particularly described as follows: All those two certain lots of parcels of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Charleston, Kanawha County, West Virginia, and abutting fifty-six feet on the southerly side of Orchard Street, and also abutting ninety feet and lying immediately west of a parcel of land owned by the Board of Education of Charleston Independent District, on which Woodrow Wilson School building is located, and is more particularly bounded and described as follows: BEGINNING at a stake in the southerly line of Orchard Street at the northwesterly corner of said lot or parcel of land owned by Board of Education; thence running in a westerly direction with the southerly line of Orchard Street a distance of fifty-six feet to a stake in the southerly line of Orchard Street; thence running in a southerly direction toward Charleston Street and fifty-six feet distance from the said Board of Education lot and parallel thereto a distance of ninety feet to a stake in the northerly line of a ten foot alley; thence running in a easterly direction parallel with Orchard Street, a distance of fifty-six feet to a stake in the westerly line of said Board of Education lot; thence running in a northerly direction with the westerly line of said Board of Education lot of a distance of ninety feet to the place of beginning. Being the same property conveyed unto BUILDING APPALACHIA, LLC, a West Virginia limited liability company, by that certain deed dated March 1, 2022, from James E. Cook, Jr., of record in the office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3122, at page 367. Being two lots identified on the Assessor's Land Books as Parcel Nos. 470 and 471 and commonly known as 1033 and 1035 Orchard Street, Charleston. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1033 & 1035 Orchard Street, Charleston, WV 25320. AND BEING the same real estate which was conveyed to Building Appalachia, LLC, by Deed dated October 25, 2022, from James E. Cook, Jr., and recorded in the Office of the Clerk of the County Commission of Kanawha County, West Virginia, in Deed Book 3122 at Page 367. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
