NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEES SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated December 11, 2023, executed by Borrower(s), Mary L. Adkins and William L. Adkins, to Louis George, Esquire and Raymond A. Nolan, Esquire and Joint Trustees either of whom may act, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5081, at Page 8596. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 185 Tommy Creek, Odd, WV 25902. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 26, 2024, of record in the Clerks Office in Book 5083, Page 5668. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:

20th day of October, 2025
at 11:00 a.m.

All of that certain tract or parcel of land situate in Slab Fork Tax District of Raleigh County, West Virginia, together with all improvements thereon and easements and appurtenances thereto belonging, and being more particularly described as follows:

Beginning at twin maples on the south side of a road, the same being .15 miles west of the Odd Post Office along the said road; thence S 4° 25’ E 69.50 feet to a 1/2" pipe; thence S 0° 13’ W 324.07 feet to a fence post on the edge of a road; thence S 88° 32’ W 506.30 feet; thence N 17° 40’ W 349.50 feet to an intersection of fences; thence N 58° 07’ E 322.70 feet to the Odd Road; thence with the said road by the following calls and distances; S 33° 41’ E 82.90 feet; S 52° 55’ E 88.00 feet; S 86° 33’ E 89.50 feet; N 75° 18’ E 122.47 feet to the beginning, containing 5.36 acres, as shown on a map entitled, "Map showing 5.36 Acres Surface the Property of Virginia Ann Walton Situated on Tommy's Creek, Raleigh County, West Virginia, .15 Miles West of Odd Post Office. Scale 1" = 100 feet. W. S. Brooks Civil & Mining Engineer. December 4, 1968, a copy of said map being attached to and made a part of the deed of conveyance to Lake Maxwell and Virginia M. Maxwell"; and which said lots or parcels of land are shown and designated upon the Raleigh County Assessor's Tax Map for Slab Fork Tax District numbered 16, as Parcel No. 31.

Being the same which Stanley Earl Cox, Sr., single by Deed dated September 23, 1991, and recorded September 25, 1991, in the County of Raleigh, State of WV in Book: 15 and Page: 1646 conveyed unto Roy Davil Cole and Mary Emeline Cole; his wife, as joint tenants, upon the death of one, the whole of the real estate herein conveyed shall then belong to the survivor.

TERMS OF SALE:

1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
