The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust executed by COMPASS COUNSELING, LLC, to WILLIAM H. FILE III, dated December 14, 2021, and of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia in Deed Book 5075, at Page 3728, and by second Deed of Trust executed by COMPASS COUNSELING, LLC, to WILLIAM H. FILE III, dated December 21, 2022, and of record in the Office of the Clerk of the County Court of Raleigh County, West Virginia in Deed Book 5078, at Page 5763, Gavin Ward being named Substitute Trustee on September 2, 2025 of record in Deed Book 5086, at Page 3326, said Deed of Trust being presently in default, the said Trustee having been requested by the beneficiary thereof so to do, NOW, THEREFORE, I, GAVIN WARD, Substitute Trustee as aforesaid, will proceed to sell the hereafter described real estate at public auction on the 13th day of November, 2025, at the hour of 11:00 A.M., to the highest bidder for cash in hand at the front door of the Courthouse of Raleigh County, West Virginia, which real estate is located in, Raleigh County, West Virginia, and is more particularly described as follows:
TRACT 1:
That certain lot of land situate on the Eastern Extension of Main Street in the City of Beckley, Raleigh County, West Virginia, and being Lot Eight (8) as laid down and designated on a map entitled "MAP SHOWING PARTITION OF THE H.W. TRAIL ESTATE, BECKLEY, WEST VIRGINIA, a copy of which map is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 61, at Page 442, reference to which map is hereby made for a more particular description of the lot hereby conveyed.
TRACT 2:
The surface, together with any appurtenances thereon, of that certain lot of land situate on the Eastern Extension of Main Street in the City of Beckley, West Virginia, and being Lot Nine (9) as laid down and designated on a map marked "Map Showing Partition of the H.W. Trail Estate, Beckley, W.Va." and of record with the deed of record in Deed Book 63, at Page 442.
And being the same property conveyed to Compass Counseling, LLC, by Carl W. Roop and Clyde A. Smith Jr., by deed dated December 3, 2021, and recorded December 15, 2021, in Deed Book No. 5075, at page 3727.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 114 E. Main Street, Beckley, West Virginia 25801.
THIS SALE IS MADE subject to such easements, rights of ways, restrictive covenants, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to said real estate.
TERMS: Ten Percent (10%) of the purchase price is payable in cash and/or certified funds as deposit at the time of the sale with the balance due and payable within 30 days of the date of sale.
SAID SALE SHALL BE SUBJECT TO THE FOLLOWING CONDITIONS:
1)Subject to any and all mineral rights and reservations, stipulations, restrictions, reservations, easements, conditions and covenants contained in all former conveyances of the subject property or appearing of record in the aforesaid Clerk's Office except any pertaining to race, color or creed.
2)Subject to all real estate taxes against said property and any taxes which constitute a lien upon the said property, but which are not yet due and payable.
3)The subject property will be sold in AS IS condition. The trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
4)The Beneficiary of the Deed of Trust and Note reserves the right to submit a bid for the property at the sale.
5)The Purchaser shall be responsible for the payment of the transfer tax and recording fees imposed by West Virginia Code sect. 11-22-1.
6)The property will be conveyed by the undersigned Trustee to the purchaser without warranty of any kind, expressed or implied.
7)The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof.
