NOTICE OF PUBLIC HEARING

Notice is hereby given that a public hearing will be held on Tuesday, July 19, 2016 at 7:00 p.m. in the Charles Town City Hall Council Chambers, 101 E. Washington Street, Charles Town, WV by the City of Charles Town Board of Zoning Appeals on the following matter:

Docket # BA 2016-0004: Variance The applicant, Jeffrey Bowers has requested a variance from the bulk and area requirements of the Zoning Ordinance for a deck at his residence located at 311 East Washington Street. The property is zoned Old Town Residential and the side yard setback requirement for this district is 10 feet. The requested setback reduction for the deck is from 10 feet to 3.29 feet.

Docket # BA 2016-0005: Variance The applicant, Shandi Ruffner has requested a variance from the bulk and area requirements of the Zoning Ordinance for a deck at her residence located at 32 Holmes Way. The property is zoned as Residential Medium-High Density and the rear yard setback is 20 feet. The requested setback reduction for the deck is from 20 feet to 13 feet.

Docket # BA 2016-0006: Special Exception The applicant, Pennoni Associates Inc., is requesting a Special Exception Use as permitted in Table 1322.04 of the Zoning Ordinance for townhomes in the Old Town Residential District.

Docket # BA 2016-0007: Variance The applicant, Pennoni Associates Inc., is requesting a variance from section 1323(F)2. of the Zoning Ordinance to allow a density of 10.5 units per acre which is above 10 units per acre permitted in the Zoning Ordinance.

Docket # BA 2016-0008: Variance The applicant, Pennoni Associates Inc., is requesting a variance from section 1322.11(B) of the Zoning Ordinance with reference to 1333.20(B) to allow for townhome development on less than 5 acres.

Docket # BA 2016-0009: Variance The applicant, Pennoni Associates Inc., is requesting a variance from section 1322.11(B) of the Zoning Ordinance with reference to 1333.20(B) to allow townhome lots to be 1,600 square feet which is less than the 2,000 square feet permitted in both the Zoning Ordinance and Subdivision and Land Development Ordinance.
