Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

January 11, 2016
10:30 a.m.

offer for sale certain property described in that certain deed of trust executed by KANDACE D. MICHAEL, given to Richard H. Talbott and David E. Thompson, as Trustees, which deed of trust is described as bearing date the 16th day of November, 2001, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 333, at Page 707; and given to secure Davis Trust Company, the payment of a note therein described.

By Substitution of Trustee dated the 17th day of November, 2015, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 541, at Page 402, Jennifer L. Morgan was appointed Substitute Trustee, and which said property is described as follows:

All those certain lots, parcels or tracts of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Leadsville District, Randolph County, West Virginia, and more particularly bounded and described as follows:

Tract No. 1: That certain tract or parcel of land situate in Leadsville District, Randolph County, West Virginia, more particularly bounded and described as follows: Beginning at a stake in the northern right-of-way of Route No. 33 running thence N. 2∂ 15 minutes E. 87 feet to a stake; thence S. 84∂ 59 minutes E. 91 feet to iron pin; thence with Isaac Moran line S. 2∂ 35 minutes W. 96.65 feet to iron pin; thence with Route No. 33 N. 78∂ 55 minutes W. 91.45 feet to place of beginning, containing 0.191 acres, more or less.

Tract No. 2: A parcel of land situate in Leadsville District, lying and being on the north side of US No. 33, two miles east of City of Elkins, Randolph County, West Virginia, more particularly described as follows:

BEGINNING at 1-1/2” iron pipe being a corner of 0.191 acre tract of land also in line with Isaac J. and Goldie Moran, N. 84∂ – 59’ W, 91.00 feet to 3/4” conduit bar.

Thence: N. 1∂ – 52’ W, 93.24 feet to 2” iron pipe at right-way line of old Seneca Road.

Thence: With right-way line of old Seneca Road, N. 86∂ -30’ E, 63.50 feet to a point,

Thence: With right-way line of old Seneca Road, S. 82∂ -30’ 37.50 feet to 1” iron pipe; also being Isaac and Goldie Moran property corner.

Thence: Leaving right-way line of old Seneca Road with property line of Isaac and Goldie Moran, S. 3∂ – 15’ W, 100.50 feet to the place of beginning containing 0.212 acres as surveyed by William E. Gibbons, May 7, 1981.

And being the same real estate conveyed to Kandace D. Michael, by virtue of a deed from John V. Michael and Kandace D. Michael, husband and wife, dated the 16th day of November, 2001, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Deed Book 481 at Page 116.

This conveyance is made subject to any and all reservations, restrictions, exceptions, rights-of-way and easements as set forth in prior instruments of record in the chain of title to said real estate.

The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down), or approved line of credit with closing to occur within thirty (30) days.

The undersigned Trustee reserves the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
