Notice is hereby given that, under authority of a certain deed of trust hereinafter described, the undersigned Trustee will, at the front door of the Randolph County Courthouse, in Elkins, West Virginia, on

January 11, 2016
11:30 a.m.

offer for sale certain property described in that certain deed of trust executed by RICHARD A. WOLFORD and MARGARET A. WOLFORD, husband and wife, to Richard H. Talbott, Jr. and David E. Thompson, as Trustees, which deed of trust is described as bearing date the 2nd day of August, 2001, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 328, at Page 531, and given to secure Davis Trust Company, Elkins, West Virginia, the payment of a note therein described, and which said property is described as follows:

A parcel or tract of land located in Leadsville District, Randolph County, on the waters of Gum Lick Run, Southwest of Gum Road, approximately one half mile along Gum Road west of the Laurel Mountain Road, more particularly described as follows:

BEGINNING at a 1/2 inch iron pipe, set in the head of a cove, on the line of Hilda Gum Wheeler, from which a 32 inch Chestnut Oak on a ridge near a fence corner bears S 9∂ 47’ E at 210.0 feet; thence along the line of Wheeler for the next three courses:

N 9∂ 47’ W a distance of 148.0 feet to an 1/2 inch iron pipe, set in a path on a ridge, from which a 17 inch Pignut Hickory in a fence line bears S 83∂ E at 8.0 feet, and a 10-inch Black Oak on the brow bears N 55∂ W at 16.2 feet;

N 32∂ 19’ E a distance of 448.2 feet to a 1/2 inch iron pipe, set on a small flat place on a hillside, from which a 4 inch Black Birch bears S 70∂ W at 11.1 feet, and a 16 inch Red Oak Bears N 88∂ E at 17.7 feet;

N 58∂ 59’ E a distance of 214.9 feet to a 1/2 inch iron pipe, set by a fence line, below a forked Scarlet Oak, one fork down, corner to Arlene Moore’s Seven Acre Parcel, from which a point in the Gum Lick Run Road bears N 58∂ 59’ E at 690.0 feet;

thence S 44∂ 02’ E along said parcel, at 176.2 feet crossing the brow of a steep ridge, 526.8 feet total to a 1/2 inch iron pipe, set on a hillside, corner to Lot Two, from which an 8 inch Pitnut Hickory bears N 77∂ W at 9.6 feet, and a 1/2 inch iron pipe, set in a hollow, bears S 44∂ 02’ E at 109.4 feet;

thence S 71∂ 27’ W along the line of Lot Two 806.6 feet to the point of beginning and containing 5.75 acres, more or less, as surveyed by Rodney W. Gardener in May 1995, and as shown as Lot One on a plat of said survey of record in the aforesaid Clerk’s Office in Deed Book 440, at Page 22. The description of Survey for the Herron/Wheeler line is of record in the aforesaid Clerk’s Office, in Deed Book 440, at Page 120.

And being the same real estate conveyed to Richard A. Wolford and Margaret A. Wolford, from Dorothy Mason, by deed dated the 2nd day of August, 2001, and of record in the Office of the Clekr of the County Commission of Randolph County, West Virginia in Deed Book 479, at Page 293.

By Substitution of Trustee dated the 30th day of November, 2015, and of record in the Office of the Clerk of the County Commission of Randolph County, West Virginia, in Trust Deed Book 541, at Page 683, Jennifer L. Morgan was appointed Substitute Trustee.

The above described property will be sold subject to all reservations, restrictions, exceptions and conditions contained in all prior deeds conveying said real estate except those pertaining to race, color or creed, and subject to all unpaid levies and assessments including real estate taxes.

TERMS OF SALE: Cash in hand on day of sale, or ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} down), or approved line of credit with closing to occur within thirty (30) days.

The undersigned Trustees reserve the right to reject any and all bids received, and to continue said sale from time to time, upon announcement thereof given verbally, on day of sale and any continuance thereof.
