Notice is hereby given that, by virtue of the authority vested in the undersigned Robert E. Glenn, IV, as Successor Trustee, by Deed of Trust made and executed by Ranson Gateway, L.L.C. (the “Borrower”) to William J. Powell, as Trustee, dated November 20, 2006, recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Trust Deed Book 1606 at page 386 (the “Original Deed of Trust”); as modified by the Amendment to Deed of Trust and Assignment of Rents from Ranson Gateway L.L.C. to William J. Powell, pursuant to the Deed of Substitution of Trustee Under Deed of Trust recorded on April 16, 2012, at Book 1107, Page 631), dated as of April 10, 2012, and recorded April 16, 2012, in Deed of Trust Book 1886, at Page 351 (collectively the Original Deed of Trust, together with all the amendments thereto, shall hereinafter be referred to as the “Deed of Trust”); and the said Robert E. Glenn, IV, acting as Successor Trustee under and by virtue of a certain Appointment of Successor Trustee, dated February 27, 2017, and recorded in the aforesaid Clerk’s office in Deed Book 1185, page 723; and default having been made in the payment of the note secured by the Deed of Trust, the owner and holder of said note having requested in writing the sale of the real estate conveyed by the Deed of Trust;

NOW, THEREFORE, the undersigned Successor Trustee, having been required so to do by said holder, iStar Inc., successor by name change to iStar Financial, Inc., will sell the real estate conveyed by the Deed of Trust at public auction to the highest bidder at the front door of the Courthouse of Jefferson County, West Virginia, in the City of Charles Town, West Virginia, on April 4, 2017, at 10:00 a.m., local time, which said real estate is more particularly described in the Deed of Trust and set forth on Exhibit A attached hereto and made a part hereof.

The above-described real estate will be conveyed by the undersigned Successor Trustee by deed without warranty of any kind, express or implied, and subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service districts / municipal sanitary boards, if any, and also further subject to (i) any liens, covenants, restrictions, conditions, reservations, rights of way and easements recorded in the aforesaid Clerk’s office prior to the Original Deed of Trust and (ii) that certain Declaration of Easements, Covenants, Obligations and Restrictions of The Boulevard At Potomac Towne Center recorded September 12, 2007, in Deed Book 2041, at page 255, together with any and all amendments and modifications thereto, and affecting the subject real estate (the “Declaration”).

TERMS OF SALE

1. Cash in hand on day of sale or cancellation of existing indebtedness in the discretion of the Successor Trustee;

2. Subject to the liens and encumbrances described above;

3. Successor Trustee shall convey the subject real estate without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the date of sale;

4. The above-described real estate will be sold by the undersigned Successor Trustee by auction to the highest bidder subject to the right of the undersigned Successor Trustee to reject all bids if, in his opinion, said bids are inadequate;

5. The owner of the indebtedness secured by the Deed of Trust shall have the right to bid; and

6. The sale shall be without representation or warranty of any kind, express or implied.

7. Successor Trustee shall convey the subject real estate together with the improvements thereon and the appurtenances thereunto belonging or otherwise appertaining, including without limitation, all of the Successor Trustee’s right, title and interest in and to the Borrower’s rights under (i) the Declaration and related documents to the extent requested by the highest bidder and (ii) any and all of the documents, agreements, and instruments related to the creation, conversion and maintenance of the development thereon.

CONTINUANCE OR ADJOURNMENT OF SALE

The undersigned Successor Trustee reserves the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
