SUCCESSOR TRUSTEE’S SALE OF VALUABLE
REAL PROPERTY
AND MOBILE HOME UNITS
Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustee, James W. Lane, Jr., by that certain Deed of Trust made by Wilbert Newsome and Karen Newsome bearing date July 5, 2007, securing a promissory note made by Wilbert Newsome and Karen Newsome, payable to United Bank, Inc., and of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Trust Deed Book 611, page 259,  the said James W. Lane, Jr. and Bradford P. Bury, acting as Successor Trustees, by virtue of that certain Appointment of Successor Trustee dated October 21, 2014, and recorded October 28, 2014 in the aforesaid Clerk’s Office in Trust Deed Book 738, at page 706, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Greenbrier County, 200 North Court Street, Lewisburg, West Virginia, on TUESDAY, the 17TH DAY of MARCH 2015, at 1:00 p.m., all that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, described as follows:
All that certain lot, tract or parcel of land together with the buildings and improvements thereon, easements, rights of way, and the appurtenances thereunto belonging, situate in Bell View Tracts, Near Frankford, in Frankford District, Greenbrier County, West Virginia, and more particularly known and described as follows:
Beginning at a ¾” iron shaft, found, in the northerly edge of the pavement of a 30 foot wide road, corner to Fred Workman (DB 368, Pg 91) and corner to Michael O’Dell (DB 450, Pg 165), of which this description is for, from which S 75°W, 50.3 feet bears telephone box 3308-002, thence leaving Workman and with the northerly right of way of the 30 feet wide road;
S 65° 08’35”W, 255.87 feet to a ½”rebar, found, at the northerly edge of the pavement, corner to Chadwick Kirk (DB 464, Pg 327), from which S 71°44’ 16”W, 278.64 feet bears a bent over 1”iron pipe, thence leaving the road and with Kirk;
N 27°33’40”W, 339.17 feet to a 1”pipe, found bent over, at the edge of a cornfield, corner to Kirk and on the line of Mrs. Gerald Bean (DB 242, Pg 269), from which S 62°16’50”W, 575.54 feet bears a 1”pipe, found, and from which S 29°06’ E, 19.56 feet bears power pole #EQ819/AJ13, thence leaving Kirk and with Bean;
N 62°50’13”E, 256.07 feet to a 1”pipe, found, near the edge of the cornfield, on the line of Bean and corner to Workman, from which N 62°32’03”E, 770.59 feet bears a ½”solid shaft, found, and from which S 25°41’ E, 18.00 feet bears power pole EQ819/AJ55, thence leaving Bean and with Workman;
S 27°28’59”E, 349.46 feet to a the point of beginning, containing 2.02 acres, as surveyed in August, 2005, by Rickford Walton, PS 856, Leivasy, WV.
And being the same real property conveyed unto Wilbert R. Newsome and Karen V. Newsome, husband and wife, by deed dated July 27, 2005 from Michael A. O’Dell and Shannon Dawn O’Dell, husband and wife, of record in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia in Deed Book 500 at Page at 380.
In addition to the real estate,  the Trustee will also sell, at the same auction, the following mobile home units titled in the names of Wilbert R. Newsome, Jr or Karen V. Newsome, that serve as collateral for United Bank’s loan:

The authority of the Trustee to sell the Mobile Home Units is the Security Agreement signed by Wilbert R. Newsome, Jr. and Karen Newsome dated July 5, 2007, pursuant to which they gave a security interest in the Mobile Home Units as collateral for the same promissory note that is secured by the Deed of Trust identified above.  United Bank Inc. is noted as a lien holder against the original certificates of title, and United Bank Inc. will assign the titles and the Mobile Home Units to the purchaser at the sale, along with a deed to the real property.
At the time of the execution of the Deed of Trust, the grantor represented that the address of the real property was 264 Bellview Estates Road, Frankford, West Virginia  24938.
TERMS OF SALE: The property will be sold “AS IS, WHERE IS,”in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title.  The real property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the deed of trust pursuant to which this sale is being conducted.  The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground.  The property will be sold for cash in hand on the date of sale to the highest bidder. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed).  The Successor Trustees and United Bank, Inc. shall not be responsible for the removal of any person or personal property from the real property.
Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
