NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE

Pursuant to the authority vested in the undersigned by deed of trust dated the 8th day of July 2005, signed by Guy A. Pedersen, a single man, to Richard A. Pill, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Trust Deed Book 397, at page 587, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 8:15 o’clock a.m. on the

7th day of JANUARY 2015

at the front doors of the Courthouse in Hampshire County in Romney, West Virginia the following described real estate:

A tract or parcel of land against the East side of Cooper Mountain about 0.3 mile North of US Route 50 and about 2.5 miles West of Capon Bridge, lying in Bloomery District of Hampshire County, West Virginia and more particularly described as follows:    Beginning at a 5/8” rebar found at the Northernmost corner of a 10.009 acre tract previously conveyed to Kirby Curtis Dove (Deed Book 396 at page 634), thence leaving the 10.009 acre tract and running with a new division line through the 405 acre tract of which this is a part N. 52 deg. 41’ 38” E. 1130.45’ to a 5/8” x 30” rebar and stone pile set in a line of a 45.000 acre tract previously conveyed to Dale W. Bidie (Deed Book 403 at page 4930 located S. 53 deg. 59’ 53’ E. 163.35’ from a 5/8” rebar found at a corner to said 45.00 acre tract, thence running with a portion of a line of same S. 53 deg. 59’ 53” E. 897.80’ to a 5/8” rebar found in line on the North side of County Route 50/24, the same course continued 20.00’ further for a total of 917.80’ to a point in the center of said road, thence running out the center of the County Road S. 52 deg. 33’ 09: W. 152.10’ S. 46 deg. 51’ W. 121.83’ S. 50 deg. 20’ 35” W. 256.98’ S. 53 deg. 42’ 52’ W. 97.57’ S. 46 deg. 06’ 47” W. 72.55’ S. 52 deg. 53’ 00’ W. 307.82’ S. 56 deg. 43’ 36” W. 205.05’ S. 50 deg. 52’ 31” W. 77.81’ to a point in the center of the road at a corner to Doves 10.009 acre tract, thence leaving the road and running with Dove N. 43 deg. 57’ 31” W. 25.000’ to a 5/8” rebar found, the same course continued 877.33’ further for a total of 902.33’ to the beginning, containing 25.000 acres, more or less.

It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.

Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.

Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
