NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE`S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill, David D. Pill, and Amanda E. Steiner, any of whom may act, by that certain Deed of Trust dated February 28, 2002, executed by Borrowers, Tommie L. Griffith and Theresa D. Griffith, to Alan H. Larrick, the Trustee of record in the office of the Clerk of the County Commission of Greenbrier County, West Virginia, in Book 470, at Page 243. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Box 366 Russellville Road, Quinwood, WV, 25981. Richard A. Pill, David D. Pill, and Amanda E. Steiner were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 16, 2014, of record in the Clerk`s Office in Book 740, at Page 524. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Greenbrier County, in Lewisburg, West Virginia, on the following date:
February 12, 2015, at 9:03 AM
The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Quinwood Corp. District, Greenbrier County, West Virginia, and being more particularly described as follows:
That certain lot or parcel of real estate situate in the Town of Quinwood, Greenbrier County, West Virginia, known and designated as Lot Number Sixteen (16) of the Michienzi Addition to Quinwood, as shown on a map of said Addition recorded in the Office of the Clerk of the County Commission of Greenbrier County, West Virginia, and which lot is more particularly bounded and described as follows:
BEGINNING on the line of Second Street, and with the southwest corner of Lot 17; thence with the western line of Lot 17 in a northeasterly direction ninety (90) feet to the corner of Lots 16 and 17 on the Nutterville-Quinwood Road; thence N 77 W, and with the northern line of said Lot 16 and the edge of the Nutterville-Quinwood Road 100 feet to the northeast corner of Lot 15; thence in a southwesterly direction, and with the eastern line of Lot 15, 125 feet to a stake on Second Street; thence with the northern edge of Second Street 105.5 feet to the place of beginning.
And being the same property acquired by Tommie L. Griffith and Theresa D. Griffith, by Deed dated December 2, 1996, from Wilma L. Cross, single, recorded in the aforesaid Clerk’s Office in Deed Book 440, at Page 663.
A copy of any notice of foreclosure sale shall be served on Grantors by certified mail, return receipt requested at the following address: P. O. Box 366, Quinwood, WV 25981, or at such other address as may be given to Lender in writing by Grantors subsequent to the execution and delivery of this deed of trust.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPER-TY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee by certified or cashier’s check within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
