NOTICE OF TRUSTEE’S SALE

To:  Isaac Lee Lewis and
Marissa Faith Rodgers-Lewis

Notice is hereby given that pursuant to the authority of that certain Deed of Trust executed by Isaac Lee Lewis and Marissa Faith Rodgers-Lewis, to Keith J. Pappas, Trustee for said Lender, said Deed of Trust bearing date of the 4th day of October, 2010, and of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Trust Deed Book No 520, at Page 657, and default having been made in the payment of the indebtedness secured by the aforesaid Deed of Trust, and further, that Keith J. Pappas as the Trustee of the aforereferenced Deed of Trust instrument has been formally instructed by said Lender, the owner and holder of the Note evidencing said indebtedness, to advertise and sell the property as hereinafter described, on the terms and provisions as more particularly set forth in said Deed of Trust. Therefore, I, Keith J. Pappas, the undersigned Trustee, will on the 2nd day of December, 2016, at 11 a.m., offer for public sale to the highest bidder, for cash, at the main entrance of the Hampshire County Courthouse, situate at 50 South High Street, Romney, West Virginia, the real estate as conveyed by said Deed of Trust and therein described as follows, to wit:

All those certain parcels of real estate, together with the buildings and improvements thereon and the appurtenances thereunto belonging, situate, lying and being in the City of Romney, in Romney District, Hampshire County, West Virginia, with a known address of 501 East Main Street, Romney, West Virginia, more particularly bounded and described as follows:

All those two tracts or parcels of real estate situate adjacent to the City of Romney, in Romney District of Hampshire County, West Virginia described as follows:

TRACT ONE
Beginning at a point 30 feet from the center line of U.S. Route No. 50, on the east side thereof and corner to Deaf and Blind School lot and the Rannells lot; thence with the original line, also line of Deaf and Blind School and Rannells lot of which this is a part of, N. 52 45 E. 140.8 feet to the base of a concrete wall on the North side of a small drain; thence S. 31 30 E. 76.5 feet with the original line of the 1/2 acre lot of which this is part, to a point in the concrete wall marked for corner; thence leaving the original line of 1/2 acre lot and making a new line of division, S. 44 W. 136.4 feet with another concrete wall to a point on the northeast side of the right of way of U.S. Route #50; thence with the east side of said turnpike N. 46 W. 35.1 feet; thence N. 42 32 WS. 47.1 feet to the beginning, containing 10,971 square feet or 0.25 acres, more or less.

TRACT TWO
All that certain tract or parcel of real estate lying between Tract One and the real estate conveyed from John R. Rannells and Anita Rannells to William J. Wylie and Frances M. Wylie by Deed dated the 10th day of August 1988 and of record in the Office of the Clerk of the County Commission, of Hampshire County, West Virginia in Deed Book 303 at Page 30. Reference is hereby made to the plat attached to the aforesaid Deed which depicts the real estate herein conveyed as being a triangular tract identified with name of John Rannells (Deed Book 158 at Page 559).

And being the same real estate conveyed to Isaac Lee Lewis and Marissa Faith Rodgers-Lewis, husband and wife, from Patricia R. Bennett and James H. Bennett; Sarah Caroline Deutsch and James Matthew Bennett by Deed dated the 16th day of August, 2010, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia in Deed Book No. 492, at Page 95.

THIS SALE is made subject to any prior liens, assessments or mortgages, persons in possession and the rights of any tenants therein and said property is being sold “as is,” and “where as,” without any representation or warranty, express or implied, as to the condition of the improvements, the availability of utilities, whether latent or patent defects may exist therein or thereon, the existence of any defect respecting the quality or marketability of the title thereof, matters which would be revealed by an accurate survey or visual inspection of the premises, the improvements thereon and its boundaries.

TERMS OF SALE: Said real estate will be sold for cash in hand on the day of the sale or other terms as may be acceptable to Lender on said day and date. All persons intending to be present at said time and place of sale, and intending to bid, must register with Trustee, showing a valid proof of identity and letter of credit from source of funds or bank in amounts equivalent to any proposed bid, plus costs. All bids may be freely assigned to qualified parties or entities, subject to Lender’s consent. Purchaser shall pay all transfer tax stamps, property taxes, advertising, recording costs, deed preparation and closing costs incurred pursuant to said bid, purchase and transfer. The undersigned Trustee reserves the right to continue said sale from time to time and to reject any and all bids or offers at any time.
