NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated January 31, 2003, executed by the Borrowers, Bonnie L. Haines, Waldo W. Haines, Jr., William D. Twigg, Jr. and Tammy L. Twigg, to Richard A. Pill, the Trustee, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Book 330, at Page 569.  At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of HC 78 Box 9C, Shanks, WV 26761. The Borrowers defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Hampshire County, in Romney, West Virginia, on the following date:

May 4, 2017 at 10:30 a.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Sherman District, Hampshire County, West Virginia, and being more particularly described as follows:

All that certain tract or parcel of real estate containing 0.7573 acres, more or less, situate in Sherman District of Hampshire County, West Virginia, known and designated as Tract 2, according to that certain survey prepared by Allen G. Clem, Licensed Land Surveyor, of record in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 353, at page 525, and by reference is expressly made a part hereof for a more particular description of said real estate.

And being the same real estate that was conveyed unto Tammy L. Riggleman, Waldo W. Haines, Jr., and Bonnie L. Haines, by deed of Ricky P. Riggleman and Tammy L. Riggleman, his wife, by deed dated the 25th day of January, 2001, and which said deed is recorded in the Office of the Clerk of the County Commission of Hampshire County, West Virginia, in Deed Book No. 404, at page 78.
And further being the same real estate conveyed to Tammy L. Twigg and William D. Twigg, Jr., her husband, and Waldo W. Haines, Jr. and Bonnie L. Haines, his wife, as joint tenants with right of survivorship, by Deed from Tammy L. Twigg, formerly Tammy L. Riggleman, and William D. Twigg, Jr., her husband, and Waldo W. Haines, Jr. and Bonnie L. Haines, his wife, dated 2/18/02, recorded 3/04/02, in the Office of the Clerk, County Commission, HAMPSHIRE COUNTY, West Virginia, in Deed Book 412, Page 294.

TERMS OF SALE:

The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the to submit a bid right for the property at sale.

The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
