NOTICE OF TRUSTEE’S SALE

NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated December 30, 2004, executed by Borrower, Barbara J. Penwell, to Richard Pill, the Trustee of record in the office of the Clerk of the County Commission of Jefferson County, West Virginia, in Book 1386, at Page 1. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 202 Peach Tree Drive, Ranson, WV 25438. The borrower defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Jefferson County, in Charles Town, West Virginia, on the following date:

June 14, 2016 at 3:42 p.m.

The property is described as of that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Charles Town District, Jefferson County, West Virginia, and being more particularly described as follows:

All of that certain parcel of real estate, with improvements thereon and appurtenances thereunto belonging, situate in Charles Town District, Jefferson County, West Virginia, just north of the City of Ranson, designated and described as all of Lot No. C-26 in the Orchard Hills Subdivision, as said lot is described on a plat of survey dated September 30, 1968, prepared by C. R. Atherton, C.E., entitled, “Orchard Hills”, recorded in the Office of the Clerk of the County Commission of Jefferson County, West Virginia, in Plat Book 1, at Page 37; together with the non-exclusive right, in common with other lot owners in said subdivision, to use the streets shown on said plats for water, electric, telephone and other utility lines, as well as for passage and transportation of all kinds, and to connect with all such utility lines as may be construed. Reference is also hereby made to a plat of survey dated May 18, 1971, prepared by C. R. Atherton, C.E., entitled. “Plat Showing Block No. 1 Consisting of Lots A 1-32, B 1-31, E 20-­23, F 11-13 & 19-26, G 1-27, Orchard Hills”, recorded in the aforesaid Clerk’s Office in Plat Book 1, at Page 189; a plat of survey dated May 28, 1971, prepared by A. G. Hooper, Jr., C.E., entitled. “Plat Showing Block No. 2, C 1-31, D 1-24, E 1-19, F 1-10, F 14-18, Orchard Hills”, recorded in the aforesaid Clerk’s Office in Plat Book 1, at Page 193; and a plat of survey dated March 23, 1972, prepared by C. R. Atherton, C.E., and revised by John S. Kusner, S.J.C., entitled, “Plat Showing Block No. 1 Consisting of Lots A 1-32. B 1-31, E 20-23, F 11-13 & 19-26, G 1-27, Orchard Hills”, recorded in the aforesaid Clerk’s Office in Plat Book 2, at Page 301.

AND BEING the same real estate conveyed to Barbara J. Penwell from John Steven Besserman and Vera Mae Besserman, husband and wife, by deed dated December 30, 2004, and recorded in the aforesaid Clerk’s Office immediately preceding this deed of trust which is a purchase money deed of trust therefore.

THIS CONVEYANCE IS MADE SUBJECT, HOWEVER, to covenants, agreements, rights of way, restrictions and easements of record.

Being the same property conveyed to Barbara J. Penwell by the Deed dated December 30, 2004 and recorded in Deed Book 1000, at Page 205 in the Office of the Clerk of the County Commission of Jefferson County, West Virginia.

TERMS OF SALE:

1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.

2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) of the total purchase price payable to the Trustee at sale.
