NOTICE OF TRUSTEE’S SALE In execution of the deed of trust, dated December 30, 2009, from Michael B. Hicks and Deana Rae Hicks to Doug Hayes, as trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1181, at page 682, the undersigned trustee will offer for sale at public auction on August 29, 2014, at 10:00 a.m. at the front door of 307 Federal Street, Bluefield, West Virginia, all that certain lot or parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Bluefield, Mercer County, West Virginia, known and designated on the map of said City as Lot No. 13, Section 893, and more particularly described as follows, to-wit: all that certain lot or parcel of real estate, together with the improvements thereon and the appurtenances thereunto belonging, situate in the City of Bluefield, Mercer County, West Virginia, known and designated on the map of said City as Lot No. 13, Section 893, and more particularly described as follows, to-wit: BEGINNING at a point in the Northern line of College Avenue (formerly Adams Street), which said beginning point is the Southwest corner of Lot No. 14, Section 893; thence S. 62? 55′ W. and with the North line of College Avenue 54 feet to a point; thence N. 27? 30′ W. 150 feet to a point in the Southern line of a ten foot wide alley; thence with the South line of said alley N. 64? 29′ E. 55.35 feet to a point; thence S. 27? 05′ E. 148.51 feet to the point of Beginning. AND BEING the same real estate conveyed unto the Parties of the First Part herein by Deed dated December 28, 2009, from Bluestone Properties, LLC, which Deed is intended to be recorded simultaneously herewith. This conveyance is made expressly subject to all pertinent restrictions, reservations, and easements of record. J. This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements, and mechanics’ and materialmen’s liens, if any, whether of record or not of record, to the extent any of the foregoing apply and take priority over the lien of the deed of trust. TERMS OF SALE: Cash in hand on day of sale. The conveyance of the real estate will be by special warranty deed. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees.
