ORDER AND NOTICE OF INTENT TO CONSOLIDATE PRECINCTS 96, 104 AND 113F

BEFORE THE COUNTY COMMISSION OF MARION COUNTY, WEST VIRGINIA
ORDER AND NOTICE OF INTENT TO
CONSOLIDATE PRECINCTS 96, 104 AND 113F
WHEREAS, the Marion County Commission pursuant to West Virginia Code Chapter 3, Article 1, Section 5, shall utilize precincts for the basic territorial election unit; and
WHEREAS, the County Commission is required to divide each Magisterial District of the County into election Precincts, to number the precincts, to determine and establish the boundaries thereof, and to designate one voting place in each Precinct which shall be established as nearly as possible at the point most convenient for the voters of the Precinct; and
WHEREAS, Pursuant to West Virginia Code Chapter 3, Article 1, Section 7, the County Commission of any County may change the boundaries of any Precinct within such County or divide any Precinct into two or more Precincts or consolidate two or more Precincts into one or change the location of any polling place whenever the public convenience may require it; and
WHEREAS, West Virginia Code Chapter 1 Article 1 Section 2b requires that no precinct contain territory included in more than one senatorial or delegate district; and
WHERAS, pursuant to West Virginia code Chapter 3, Article 1, Section 7, the County Commission which is considering changes as noted above must adopt an order of intent to do so and run a Class II legal advertisement in the publication which covers the Precinct (s) area (s); and
WHEREAS, the County Commission of Marion County, West Virginia finds that it is in the interests and convenience of the voters of Marion County to adopt an order consolidating Precincts 96, 104, and 113F into one precinct to be known as Precinct 96; and
Accordingly, it hereby Ordered and Notice is hereby given that the County Commission of Marion County, West Virginia intends to consolidate Precincts 96, 104, and 113F into one precinct to be known as Precinct 96.
It is further Ordered that the physical boundaries of Precinct 96 shall be as follows:
BEGINNING AT THE CENTER LINE INTERSECTION OF MORGANTOWN AVENUE AND ELKINS STREET AND RUNNING SOUTHEASTERLY WITH THE CENTER LINE OF MORGANTOWN AVENUE TO THE CENTER LINE OF EAST GRAFTON ROAD PROJECTED; THENCE, WITH THE CENTER LINE OF EAST GRAFTON ROAD SOUTHERLY TO THE CITY OF FAIRMONT CORPORATION LINE; THENCE, COUNTER CLOCKWISE WITH THE CITY OF FAIRMONT CORPORATION LINE TO THE EASTERN LINE OF THE GATEWAY HIGHWAY; THENCE, SOUTHERLY WITH THE EASTERN LINE OF THE GATEWAY ROAD AND STONEY HOLLOW ROAD TO THE INTERSECTION OF STONEY HOLLOW ROAD AND PINCH GUT HOLLOW ROAD; THENCE, DOWN THE EASTERN SIDE OF PINCH GUT HOLLOW ROAD TO THE SOUTHERN LINE OF SALLYFIELD ESTATES PROJECTED; THENCE, CROSSING PINCH GUT HOLLOW ROAD TO THE FAIRMONT CORPORATION LINE; THENCE, FOLLOWING THE CITY OF FAIRMONT CORPORATION LINE CLOCKWISE AROUND SALLYFIELD ESTATES BACK TO THE WESTERN SIDE OF PINCH GUT HOLLOW ROAD; THENCE, NORTHERLY ON THE WESTERN SIDE OF PINCH GUT HOLLOW ROAD TO THE INTERSECTION OF PINCH GUT HOLLOW ROAD AND STONEY HOLLOW ROAD; THENCE, NORTHERLY WITH THE WESTERN SIDE OF STONEY HOLLOW ROAD AND GATEWAY ROAD TO THE FAIRMONT CORPORATION LINE; THENCE, CLOCKWISE WITH THE FAIRMONT CORPORATION LINE TO THE CENTER LINE OF COLUMBIA STREET PROJECTED; THENCE, WITH THE CENTER LINE OF COLUMBIA STREET EASTERLY WITH THE CENTER LINE INTERSECTION OF MARKET STREET; THENCE, SOUTHERLY WITH THE CENTER LINE OF MARKET STREET TO THE CENTER LINE INTERSECTION OF ELKINS STREET; THENCE, EASTERLY WITH THE CENTER LINE OF ELKINS STREET TO THE INTERSECTION OF THE CENTER LINE OF MORGANTOWN AVENUE, THE PLACE OF BEGINNING;
TO BE KNOWN AS PRECINCT NO. 96.
The designated place of voting for Precinct 96 shall be the Marion County Police Reserves Building.
It is further Ordered that unless substantial and reasonable objection be made to the said changes, on or before the 8th day of January, 2020, at which time the Commission will sit at 10:00 a.m. at the J. Harper Meredith Building, on the 4th floor in the Commission Chambers, Room 403, in Fairmont, Marion County, West Virginia to hear any and all such objections, the Commission will enter the required order making the said changes.
And it is further ordered that this said order and notice of the said changes be published and posted as required by law.
All of which is done pursuant to the provisions of Chapter 3, Article 1, Section 7, of the Code of West Virginia as amended.
