The object of the above entitled action is to declare by Order, pursuant to W.Va. R. Civ. P. 57 and W.Va. Code §55-13-1 et. seq., Petitioner the proper holder of a certain Note in due course and to appoint a substitute trustee under the terms of a certain Deed of Trust, which secures the first lien mortgage upon real estate. The real estate securing said Note, which is the subject of this action, was purported to be the home of the Morris and Nicholas Respondents.
And it appearing by an affidavit filed in this action that personal service upon the Respondent Nicholas was attempted by the Marion County Sheriff’s Department, without effect, and that the Petitioner used due diligence to ascertain the whereabouts of the said Respondent, without effect,
It is hereby ORDERED that Rosalie Nicholas, do serve upon Rhonda Starn, Marion County Circuit Clerk, whose address is 219 Adams Street, Room 211, Fairmont, WV 26554, and Ryan Keesee, Attorney for Petitioner, 55 Meridian Parkway, Suite 108, Martinsburg, WV 25404, an answer or other defense to the petition filed in this action on or before Thirty (30) days from the date of first publication, otherwise judgement by default will be taken against Rosalie Nicholas at any time thereafter. A copy of said petition can be obtained from the undersigned Clerk at her office.
