ORDER OF PUBLICATION
Petitioner, LSCG Fund 11, LLC, (“Petitioner”), by counsel, pursuant to Rule 4(e)(1)(B) and (C) submits this Order of Publication to effect service by publication in the action captioned LSCG Fund 11, LLC v. Shenandoah Lanes, Incorporated, Patrick L. Paden, Sujoy Gill and Jyotsna Milbourne as Co-Personal Representatives of the Estate of Satinder P. Gill, Walter E. Hersh, Babulal Pragani, and Deepinder S. Grewal, Civil Action No. 14-C-419, for Respondents, Patrick L. Paden and Deepinder S.Grewal. The above referenced action was filed to determine the priority of a Credit Line Deed of Trust and Security Agreement executed by all Respondents. A copy of the Petition may be obtained from the Clerk of Jefferson County, West Virginia by referencing the Civil Action number above. Respondents, Patrick L. Paden and Deepinder S. Grewal, are each believed to be non-residents of West Virginia without an agent or attorney-in-fact present in the state and cannot be located despite due diligence following extensive public records searches. Each is required to appear or submit a response within thirty (30) days of May 27, 2015, otherwise a judgment by default will be rendered against any Respondent who does not appear or respond.
IT IS THEREFORE ORDERED that Petitioner be and hereby is granted leave to serve Respondents, Patrick L. Paden and Deepinder S. Grewal, via publication;
IT IS FURTHER ORDERED that such publication shall be made once a week for two consecutive weeks in the Spirit of Jefferson and Martinsburg Journal in accordance with West Virginia Rule of Civil Procedure 4; and
IT IS FURTHER ORDERED that service shall be complete at the expiration of the first day of the second week after the first publication; and
IT IS FURTHER ORDERED that the Respondents are required to serve their written answer with the Clerk of this Court, and with a copy of said answer served upon Petitioner’s attorney within THIRTY (30) days after constructive service of this summons.
