The above-captioned civil action concerns and involves a proceeding in which the Petitioners, American Shale Development, Inc., a Delaware corporation, and Republic Energy Ventures, LLC, a Delaware limited liability company, have requested that the Circuit Court of Marion County, West Virginia, order and decree that, among other things, those certain mineral interests located and situate in Mannington District, Marion County, West Virginia, described as containing 89 ? acres, more or less, and generally overlain by those tracts identified as surface tax map numbers: 24.12.49.05 24.12.49.05.1; 24.12.49.05.2; 24.12.49.05.3; and 24.12.49.05.4 (“Subject Property”), be leased to the Petitioners, and that a special commissioner be appointed and authorized by the Court to execute and deliver a valid lease of the Defendants’ interests in the Subject Property.
Based upon the Petition filed with the Court by the Petitioners, it appears that there are persons or parties whose names and/or identities are known to the Petitioners, but who the Petitioners have been unable to locate by the exercise of due diligence, and that there also may be persons or parties whose names and/or identities are unknown to the Petitioners and who the Petitioners have been unable to identify by the exercise of due diligence, which person or parties are as follows:

A copy of the petition in the above-captioned civil action may be obtained from the Clerk of the Circuit Court of Marion County, West Virginia.
Each named and un-locatable defendant and each unidentifiable defendant must appear before the Court to respond to such complaint and/or defend such civil action on or before December 25, 2014, otherwise, judgment by default may be rendered against such respondent at any time thereafter.
