THE OBJECT OF THE ABOVE TITLED ACTION IS TO PARTITION FOR SALE A CERTAIN PIECE OF PROPERTY SITUATE IN NEW HAVEN DISTRICT, FAYETTE COUNTY, WEST VIRGINIA, AND BEING MORE PARTICULARLY BOUNDED AND DESCRIBED AS FOLLOWS: BEGINNING on the road leading to Schofield Rombaut’s a common corner between the parties of the first part and George C. Pennington, thence up said road 600 feet to a stake in the edge of said road, thence in an easterly direction to a stake on the right of way road described in the deed of Homer F. Teel and others, hereinafter referred to, thence in a northerly direction down and with said right of way road to a white oak, a common corner of the parties of the first part and Pennington, and with the line of the parties of the first part and Pennington in a westerly direction to the beginning, containing 10 acres more or less, it being understood that this land is conveyed by the boundary and not the acre. To the Above Named Defendants: It appearing by affidavit filed in this action that the above named defendants are either non-residents of the State of West Virginia or their addresses are unknown, it is hereby ordered that the above named defendants serve upon Philip J. Tissue, plaintiff’s attorney, whose address is 303 Jones Avenue, Oak Hill, West Virginia 25901, an Answer, or other defense filed in this action on or before 20 days from the date of the last publication of this Order, otherwise judgment by default will be taken against them at any time thereafter.
