ORDER OF PUBLICATION
This action seeks partition of the mineral interests underlying certain property located in Clay District, Ritchie County, West Virginia (“Subject Minerals”), pursuant to West Virginia Code Section 37-4-1 et seq. The surface estate overlying the Subject Minerals is identified by the Ritchie County Assessor’s Office as Tax Map 15, Parcel 9; Tax Map 15, Parcel 9.1; Tax Map 15, Parcel 13; Tax Map 15, Parcel 14; and Tax Map 15, Parcel 14.1; Tax Map 15, Parcel 15; Tax Map 15, Parcel 15.1 Tax Map 15, Parcel 17; Tax Map 15, Parcel 17.1; Tax Map 15, Portion of Parcel 18; and Tax Map 15, Portion of Parcel 19, Clay District.
It appearing by affidavit filed in this action that Plaintiff Antero Resources Corporation (“Antero”) has exercised due diligence to ascertain the residence or whereabouts of all owners of the Subject Minerals, and that there may be persons, other than those named in the Complaint as defendants, with an interest in the Subject Minerals of the action, whose names are unknown to Antero and who are made defendants by the general description of unknown defendants, it is hereby ORDERED that any and all parties who claim an interest in the Subject Minerals must appear and serve upon Plaintiff Antero Resources Corporation’s counsel, W. Henry Lawrence, Allison J. Farrell, and Braden L. Christopher of the law firm of Steptoe & Johnson PLLC, whose address is 400 White Oaks Boulevard, Bridgeport, WV 26330, an Answer or other defense to the Complaint filed in this action by February 27, 2015, which is not fewer than thirty days after the date of the first publication of this notice, otherwise judgment by default will be rendered against him or her at any time thereafter.
A copy of the Complaint can be obtained from the Circuit Clerk’s office in the Ritchie County Courthouse located at 115 E. Main Street, Harrisville, WV 26362.
