ORDINANCE 2025-07 ORDINANCE OF THE COMMON COUNCIL OF THE VILLAGE OF BARBOURSVILLE, CABELL COUNTY, WEST VIRGINIA, AUTHORIZING THE SUBMISSION TO THE QUALIFIED VOTERS OF THE VILLAGE THE QUESTION OF AN ADDITIONAL LEVY FOR CURRENT EXPENSES UNDER THE PROVISIONS OF SECTION 16, ARTICLE 8, CHAPTER 11 OF THE CODE OF WEST VIRGINIA, AS AMENDED, PROVIDING FOR THE PUBLICATION OF THIS ORDINANCE AND NOTICE OF SUCH ELECTION, AND STATING THAT THE QUESTION OF SUCH ADDITIONAL LEVY SHALL BE SUBMITTED TO A VOTE AT A SPECIAL ELECTION TO BE HELD ON THE 10TH DAY OF FEBRUARY, 2026. ORDINANCE, ORDER AND NOTICE TAKE NOTICE THAT, this Ordinance, Order and Notice, read by title at two meetings of the Common Council of the Village of Barboursville, County of Cabell, State of West Virginia, held on the 18th day of November, 2025, and on the _____ day of _____ 2025, as provided by law, were made and entered of record, to-wit: WHEREAS, this Ordinance shall be read by title at not less than two meetings of the Common Council, with at least one week intervening between such readings, and shall be published as a Class I-0 legal advertisement in compliance with Section 4, Article 11, Chapter 8 of the Code of West Virginia, as amended; and WHEREAS, upon final adoption, the full text of this Ordinance shall be published to serve both as the required legal advertisement and as notice of election in accordance with law. NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE VILLAGE OF BARBOURSVILLE, CABELL COUNTY, WEST VIRGINIA, that the following provisions are hereby enacted and shall have the full force and effect of law upon adoption and publication: The council of the Village of Barboursville, being of the opinion that the Maximum Levies for current expenses authorized by Article 8, Chapter 11, of the Code of West Virginia, as amended, will not provide sufficient funds for the payment of current expenses of the Village of Barboursville, including expenditures for the purpose or purposes hereinafter set forth, and that an election should be held to increase such levies under the provisions of Section 16, Article 8, Chapter 11 of the Code of West Virginia, as amended, it is hereby ordained and ordered: 1. That the purposes for which additional funds are needed are as follows: A. To provide funds to surface, resurface, repair or improve all or portions of the Village's streets, sidewalks, curbs and related appurtenances as needed; B. To provide funds to upgrade storm drains and provide storm drain equipment C. To provide funds for maintenance of facilities and equipment for the Village's Street Department; D. To provide funds for equipment for the Village Sanitation Department; E. To provide funds for the Barboursville Volunteer Fire Department. F. To provide funds for planning, construction, maintenance and development of a multi-purpose recreational facility. 2. That the total approximate amount of Proposed Revenue for said purposes is as follows: (Annual Total) A. $218,230 or 33% of total received. B. $145,487 or 22% of total received. C. $ 99,196 or 15% of total received. D. $ 46,291 or 7% of total received. E. $ 85,970 or 13% of total received. F. $ 66,130 or 10% of total received. Total: $661,304 That the total approximate amount of Projected Tax Collection for said purposes is as follows: (Annual Total) A. $ 203,173 or 33% of total received. B. $ 135,448 or 22% of total received. C. $ 92,351 or 15% of total received. D. $ 43,097 or 7% of total received. E. $ 80,038 or 13% of total received. F. $ 61,567 or 10% of total received. Total: $615,674 This amount reflects the uncollectible tax amount at 7%. 3. That the approximate amount of Projected Revenue for said purposes is as follows: (Grand Total for Levy Term) A. $1,091,152 or 33% of total received. B. $ 727,434 or 22% of total received. C. $ 495,978 or 15% of total received. D. $ 231,456 or 7% of total received. E. $ 429,848 or 13% of total received. F. $ 330,652 or 10% of total received. Total: $3,306,520 That the approximate amount of Projected Tax Collection for said purposes is as follows: (Grand Total for Levy Term) A. $1,015,862 or 33% of total received. B. $ 677,241 or 22% of total received. C. $ 461,756 or 15% of total received. D. $ 215,486 or 7% of total received. E. $ 400,188 or 13% of total received. F. $ 307,837 or 10% of total received. Total: $3,078,370 This amount reflected the uncollectible tax of 7%. 4. That the separate and aggregate assessed valuation of each class of taxable property within the Village of Barboursville is as follows: CLASS I $ 0 CLASS II $ 98,874,120 CLASS IV $215,084,771 5. That the proposed additional rate of levy in cents per one hundred dollars of assessed valuation on each class of property is as follows: CLASS I 6.25 cents per $100.00 of assessed valuation. CLASS II 12.50 cents per $100.00 of assessed valuation. CLASS IV 25.00 cents per $100.00 of assessed valuation. 5a. That in the event the separate and aggregate assessed value of each class of taxable property within the Village of Barboursville increases during the term of the special excess levy, the funds generated in excess of the projected tax revenue of $3,078,370 shall be appropriated proportionately to the same purposes. In the event that funds designated for any purpose set forth herein cannot be expended for such intended purpose during the term of this levy, whether by reason of the discontinuance, dissolution, or infeasibility of that purpose or the organization to which such funds are allocated, such funds, including any unexpended balances and future distributions, shall be reallocated proportionately among the remaining authorized purposes of this levy. 6. That the proposed years to which the additional levy shall apply are the fiscal years beginning July 1, 2026, July 1, 2027, July 1, 2028, July 1, 2029 and July 1, 2030. 7. That the Council will not issue bonds upon approval of the proposed levy. 8. That the question of such additional levy shall be submitted to a vote at a Special Election to be held on the 10th day of February 2026. 9. That notice calling such elections shall be given by the publication of this order at least once each week for two successive weeks before said election in two newspapers of opposite politics and of general circulation in the territory in which the election is held. If there is only one newspaper published in the county, said publication shall be made therein. All the provisions of the laws concerning general elections shall apply as far as they are practicable, except that a separate ballot shall be used as such election when held in connection with any other election. 10. That the ballot to be used at such election shall be in the following forms: OFFICIAL LEVY BALLOT Special election to authorize additional levies for the fiscal years beginning July 1, 2026, July 1, 2027, July 1, 2028, July 1, 2029, and July 1, 2030 and for the purpose of A. Street Repair and Replacement, B. Storm Sewers, C. Maintenance Facilities and Equipment for Street Department, D. Equipment for Sanitation Department, E. Barboursville Volunteer Fire Department F. Planning, construction, maintenance and development of a multi-purpose recreational facility, entered this ______ day of __________ 2025. The additional levy shall be on Class I property, 6.25 cents; on Class II property, 12.50 cents; on Class IV property, 25.00 cents per $100.00 of assessed valuation. That in the event the separate and aggregate assessed value of each class of taxable property within the Village of Barboursville increases during the term of the special excess levy, the funds generated in excess of the projected annual tax of $615,674 shall be appropriated proportionately to the same purposes.
