ORDINANCE 250
“AN ORDINANCE ENACTING ARTICLE 730 OF THE CODIFIED ORDINANCES OF THE CITY OF LEWISBURG, GREENBRIER COUN-TY, WEST VIRGINIA, BY ADDING  SECTIONS 730.01, 730.02, 730.03, 730.04, 730.05, 730.06, 730.07, 730.08, 730.09, 730.10 AND 730.11 ENTI-TLED ‘FIRE SERVICE FEE’ TO PROVIDE THAT THE LEWISBURG FIRE DEPARTMENT SHALL RE-SPOND TO ANY FIRE INCIDENT WITHIN ITS FIRST DUE AREA AS DESIGNATED BY THE WEST VIR-GINIA STATE FIRE COMMISSION AND WEST VIRGINIA STATE FIRE MARSHALL PROVIDING RATES AND CHARGES FOR FIRE FEES FOR PROPERTIES LOCATED OUTSIDE THE CORPORATE LIMITS OF THE CITY OF LEWISBURG BUT WITHIN THE CITY’S FIRST DUE AREA. ”
WHEREAS, The Lewisburg Fire Department provides fire protection services within its First Due Area as designated by the West Virginia Fire Commission, which area includes both inside and outside of the municipal corporate limits of the City of Lewisburg; and,
WHEREAS, the City of Lewisburg currently collects municipal service fees, excess levy and ad valorum taxes from users who resided within the corporate limits of Lewisburg which generates revenue which provides funding of the Lewisburg Fire Department; and,
WHEREAS, the implementation of a fire service fee is necessary to support the Lewisburg Fire Department for fire services by users outside of the City of Lewisburg; and,
WHEREAS,  users and beneficiaries of the services provided by the Lewisburg Fire Department outside of the corporate limits currently pay no fire fee or municipal property taxes and therefore provide no funding for the Lewisburg Fire Department; and,
WHEREAS, the governing body of the City of Lewisburg has determined that in order to fairly equalize and apportion the cost of providing fire protection services it is necessary, pursuant to West Virginia Code 8-13-13, to assess a fire fee outside of the corporate limits but within its First Due Area upon the users and beneficiaries of the fire service provided by the Lewisburg Fire Department in order to provide revenue to fund a portion of the cost necessary to provide fire protection services to said users and beneficiaries, imposed by this Article;
NOW, THEREFORE BE IT OR-DAINED BY THE COUNCIL OF THE CITY OF LEWISBURG, GREEN-BRIER COUNTY, WEST VIRGINIA, THAT ARTICLE 730 OF THE CODIFIED ORDINANCES OF THE CITY BE, AND THE SAME IS HEREBY AMENDED, ENACTED, AND REENACTED TO AMEND SECTION AND TO ADD SECTIONS  730.01, 730.02, 730.03, 730.04, 730.05, 730.06, 730.07, 730.08, 730.09, 730.10 AND 730.11
