EMERGENCY ORDER CHANGING THE LOCATION OF THE POLLING PLACE FOR PRECINCT 120 PALATINE MAGISTERIAL DISTRICT OF MARION COUNTY, WEST VIRGINIA FOR THE NOVEMBER 6, 2018 GENERAL ELECTION
WHEREAS, pursuant to Chapter 3, Article 1, Section 5 of the revised Code of West Virginia the County Commission of Marion County, shall utilize precincts for the basic territorial election unit; and
WHEREAS, the County Commission shall divide each Magisterial District of the County into election precincts, shall number the precincts, and shall designate one voting place in each precinct which shall be established as nearly as possible at the point most convenient for the voters of the precinct; and
WHEREAS, pursuant to West Virginia Code Chapter 3, Article 1, Section 7, the County Commission of any county may change the location of any polling place whenever the public convenience may require it; and
WHEREAS, the Victory Baptist Church Hall which has in past elections been used as the polling place for precinct 120 in the Palatine Magisterial District of Marion County is not available for use during the November, 2018 General Election; and
WHEREAS, the County Commission therefore finds it necessary to establish a new polling place for Precinct 120 in the Palatine Magisterial District of Marion County for the November 6, 2018 General Election only.
It is therefore ORDERED that the polling place for Precinct 120 in the Palatine Magisterial District of Marion County shall be the Victory Baptist Church Teen Center located at 1886 Morgantown Avenue Fairmont, West Virginia, for the November 6, 2018 General Election only.
It is further ORDERED that the Clerk of the County Commission of Marion County shall give notice of such change by publishing notice of this change as a Class II-O Legal Advertisement in compliance with provisions of Article 3 Chapter 59 of the West Virginia Code, as amended and by posting notice of such change on election day on the door of the previous polling place describing the location of the newly established polling place and shall mail written notification to all registered voters affected by the change.
It is further ORDERED that the Clerk of the County Commission of Marion County shall make known by proclamation to voters present at the time for opening the polls, and by posting a notice at or near the entrance of the first named polling place, the location at which the election will be held.
The Clerk of the County Commission shall place a copy of this Order in the Election Precinct Record Book.
