Polling Place Changes

BEFORE THE COUNTY COMMISSON
OF MARION COUNTY, WEST VIRGINA
EMERGENCY ORDER ESTABLISHING REGIONAL POLLING PLACES AND CHANGING OR COMBINING PRECINCT POLLING PLACES
FOR THE JUNE 9, 2020 PRIMARY ELECTION
WHEREAS, pursuant to West Virginia Code Chapter 3, Article 1, Section 5, the County Commission of each county shall utilize precincts for the basic territorial election unit; and
WHEREAS, pursuant to West Virginia Code Chapter 3, Article 1, Section 7, the County Commission of any county may change the location of any polling place for any precinct whenever the public convenience may so require; and
WHEREAS, COVID-19, caused by the novel coronavirus, has been declared a pandemic by the World Health Organization (WHO); and
WHEREAS, on the 16th day of March, 2020 the Governor of the State of West Virginia declared a State of Emergency throughout the state for a natural disaster caused by the COVID-19 pandemic; and
WHEREAS, on the 20th day of March, 2020 the West Virginia Secretary of State filed Emergency Rule 153CSR53 “Election Processes and Absentee Eligibility During State of Emergency”; and
WHEREAS, Section 7.1 of the aforementioned Emergency Rule provides that if for any reason a designated precinct’s polling place is unavailable during a state of emergency the County Clerk may direct the poll workers to hold the election at the nearest place which can be secured for the purpose of voting, which may include combining multiple precincts into a new polling place; and
WHEREAS, The Clerk of the County Commission of Marion County has advised the County Commission that there may be an insufficient number of poll workers to staff all current polling locations and accordingly several designated precinct polling places will be unavailable for the June 9, 2020 Primary Election. The Marion County Clerk has further advised the County Commission of the necessity of combining several polling places into one location; and
WHEREAS, the County Commission believes it is vital to ensure that every voter has access to a polling place, thereby enhancing voter enfranchisement in Marion County and ensuring the integrity of the election process.
Accordingly, the County Commission finds it necessary to establish regional polling places at various locations throughout the county by combining or changing current precinct polling places for the June 9, 2020 Primary Election.
It is therefore ORDERED that for the June 9, 2020 Primary Election the precincts of Marion County shall be organized into nine polling places as follows:
MARION COUNTY ELECTION CENTER
4 Auburn Street, Fairmont, WV 26554
Precincts 1, 2, 7, 16, 18, 20, 96, 102, 111, 112, and 113
The polling place for Precincts 1, 2, 7, 16, 18, 20, 96, 102, 111, 112 and 113 shall be the Marion County Election Center located at 4 Auburn Street, Fairmont, WV, for the June 9, 2020 Primary Election.
FAIRMONT SENIOR FIELD HOUSE
1516 Mary Lou Retton Drive, Fairmont, WV 26554
Precincts 13, 27, 28, 29, 30, 32, 33, 34, 36, 42, 43, 45, and 48
The polling place for Precincts 13, 27, 28, 29, 30, 32, 33, 34, 36, 42, 43, 45, and 48 shall be the Fairmont Senior Field House located at 1516 Mary Lou Retton Drive, Fairmont, WV, for the June 9, 2020 Primary Election.
EAST DALE ELEMENTARY SCHOOL
57 East Dale Road, Fairmont, WV 26554
Precincts 98, 100, 101, 120, 121, 123, and 124
The polling place for Precincts 98, 100, 101, 120, 121, 123, and 124 shall be the East Dale Elementary School located at 57 East Dale Road, Fairmont, WV, for the June 9, 2020 Primary Election.
QUIET DELL COMMUNITY BUILDING
2424 East Grafton Road, Fairmont, WV 26554
Precincts 114, 115, 125
The polling place for Precincts 114, 115, and 125 shall be the Quiet Dell Community Building located at 2424 East Grafton Road, Fairmont, WV, for the June 9, 2020 Primary Election.
WHITE HALL PUBLIC SAFETY BUILDING
118 Tygart Valley Mall, White Hall, WV 26554
Precincts 38, 39, 40, 41, 116, 117, and 119
The polling place for Precincts 38, 39, 40, 41, 116, 117, and 119 shall be the White Hall Public Safety Building located at 118 Tygart Valley Mall, White Hall, WV, for the June 9, 2020 Primary Election.
RIVESVILLE COMMUNITY BUILDING
200 Jasper Street, Rivesville, WV 26588
Precincts 5, 6, 82, 83, 86, 88, 90, and 92
The polling place for Precincts 5, 6, 82, 83, 86, 88, 90, and 92 shall be the Rivesville Community Building located at 200 Jasper Street, Rivesville, WV, for the June 9, 2020 Primary Election.
FARMINGTON COMMUNITY BUILDING
1975 Ray Kelley Avenue, Farmington, WV 26571
Precincts 51, 53, 55, 56, 61, 87, and 89
The polling place for Precincts 51, 53, 55, 56, 61, 87, and 89 shall be the Farmington Community Building located at 1975 Ray Kelley Avenue, Farmington, WV,  for the June 9, 2020 Primary Election.
MONONGAH TOWN HALL
430 Bridge Street, Monongah, WV 26554
Precincts 31, 44, 47, 50, 52, 57 and 59
The polling place for Precincts 31, 44, 47, 50, 52, 57, and 59 shall be the Monongah Town Hall Building located at 430 Bridge Street, Monongah, WV, for the June 9, 2020 Primary Election.
MANNINGTON MIDDLE SCHOOL
113 Clarksburg Street, Mannington, WV 26582
Precincts 66, 67, 68, 69, 72, 74, and 78
The polling place for Precincts 66, 67, 68, 69, 72, 74, and 78 shall be the Mannington Middle School located at 113 Clarksburg Street, Mannington, WV, for the June 9, 2020 Primary Election.
It is further ORDERED that the Clerk of the County Commission of Marion County shall give notice of such change by publishing notice of this Order as a Class II-O Legal Advertisement in compliance with provisions of Article 3 Chapter 59 of the West Virginia Code, as amended.
It is further ORDERED that the Clerk of the County Commission of Marion County shall make known to voters of the original polling place the address and directions to the new polling place location by proclamation to any voters present at the time for opening the polls, and by posting a notice at or near the entrance of the original polling place for each precinct referenced herein.
It is further ORDERED that the Clerk of the County Commission of Marion County shall utilize social media and other media outlets to inform all voters affected by this ORDER of the address and directions to the new polling place for each precinct referenced herein.  The nature and frequency of social media outreach and the nature and frequency of other media outlet use shall be within the discretion of the Marion County Clerk.
It is further ORDERED that the Clerk of the County Commission of Marion County shall post notice on the Marion County, West Virginia, website of the change in location and the address and directions to the new polling place for each precinct referenced herein.
Pursuant to the provisions of 153CSR53 the precinct location changes herein ordered shall be in effect only until the conclusion of the June 9, 2020 Primary Election.
At the conclusion of the June 9, 2020 Primary Election this Order shall expire and all precinct polling places shall revert to the original precinct polling place for each precinct affected by this Order.  No subsequent Order or other action of this Commission shall be necessary to reestablish such original precinct polling places.
The Clerk of the County Commission of Marion County shall place a copy of this Order in the Election Precinct Record Book.
