NOTICE OF TRUSTEE’S SALE

In execution of the deed of trust, dated March 7, 2012, from Larry W. Proffitt, Jr., Carol S. Proffitt, Larry W. Proffitt and Angela Proffitt to Stephen M. Feola and Gary R. Mills, as trustees, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1229, at page 285, the undersigned trustee will offer for sale at public auction on August 22, 2019, at 12:00 p.m. noon at C & L Country Corner, 16394 Beckley Road, Camp Creek, West Virginia, the following:

PARCEL 1:
All that certain tract or parcel of land, with the improvements thereon and the appurtenances thereunto belonging, situate and being on the waters of Camp Creek in Jumping Branch District, Mercer County, West Virginia, as shown upon a plat entitled “Plat of Survey Showing the Remainder of the Gary Keith Meadows Parcel as Described in Deed Book 573, at Page 228, which is Situate on the Waters of Camp Creek in Jumping Branch District, Mercer County, West Virginia Scale 1″= 50′, 2/24/83, Dana Pettrey & Associates”, said plat of record in Microfilm Plat Record 8722 and more particularly bounded and described as follows:
BEGINNING at an iron pin set 1 foot east of a right-of-way fence which marks the intersection of the west right-of-way of the Old Routes 19 and 21; thence N. 3deg. 35′ 52″ E. 395.98 feet with the east controlled access right-of-way of the recently relocated Routes 19 and 21 to an iron pin set 1 foot northeast of a fence corner; thence running with the east right-of-way line of the recently relocated Routes 19 and 21 the following calls: N. 3deg. 00′ 28″ W. 131.12 feet to a concrete monument found; thence N. 12deg. 23′ 12″ E. 95.37 feet chord bearing to an iron pin set; thence S. 81deg. 56′ 11″ E. 15.0 feet to a point; thence N. 7deg.43′ E. 46.5 feet to an iron pin set in the west right-of-way line of the Old Routes 19 and 21; thence running with the west right-of-way of the Old Routes 19 and 21 the following calls: S. 18deg. 31′ E. 161.0 feet to an iron pin set; thence S. 71deg. 29′ W. 15.0 feet to an iron pin set; thence S. 2deg. 10′ W. 304.54 feet chord bearing to an iron pin set: thence S. 22deg. 51′ W. 218.67 feet to the beginning and containing 0.973 acres, more or less.

PARCEL 2:
Situate in Jumping Branch District, Mercer County, West Virginia, as shown upon a plat of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 643, at Page 4, and more particularly described as follows:
BEGINNING at a point in the eastern existing right of way line of U.S. Route 19, said point being 55 feet radially right of U.S. Route Centerline Station 61 + 60, Project 1-77-2(14) 17, Mercer County, West Virginia; thence northwesterly 58 feet more or less, to a point 45 feet radially right of Centerline Station 62 + 13; thence northeasterly 58 feet more or less, to a point in the eastern existing right of way line of U.S. Route 19, said point being 72 feet radially right of Centerline Station 62 + 66; thence, southwesterly with said existing right of way line, in a reverse centerline direction, concentric to centerline, 47 feet, more or less, to a point 72 feet radially right of Centerline Station 62 + 61; thence northwesterly with said existing right of way line 15 feet to a point 57 feet radially right of Centerline Station 62 + 61; thence, southwesterly continuing with said existing right of way line 63 feet, more or less, to the place of beginning, and containing 982 square feet, more or less.
And being part of the same real estate conveyed unto Larry W. Proffitt, Jr. and Carol S. Proffitt from Harold B. Wolfe, III, Substitute Trustee, by that Deed dated August 25, 2006, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Deed Book 901 at Page 275.
The deed of trust states that the address of this real estate is commonly known as 16394 Beckley Road (on Route 19), Camp Creek, West Virginia 25820.
J. Peter Richardson was appointed substitute trustee by the APPOINTMENT OF SUBSTITUTE TRUSTEE, dated May 13, 2019, of record in said Clerk’s Office in Trust Deed Book 1372, at page 750.
This sale will include all rights, easements, appurtenances, improvements and structures that are part of the real estate described above. This sale will be subject to all restrictions, rights-of-way, conditions, easements and matters of record, mechanics’ and materialmen’s liens, if any, whether of record or not of record, and unpaid real estate taxes, to the extent any of the foregoing apply and take priority over the lien of the deed of trust.
TERMS OF SALE: Payment of 10 {4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the purchase price by cashier’s or certified check on the day of sale with the balance due within 30 days of the day of sale. The conveyance of the real estate will be by a deed without any covenant or warranty, express or implied. The real estate and any improvements thereon will be sold in “as is” condition without any warranties. The successful bidder will assume the risk of all loss or damage to the real estate and any improvements thereon after the sale, and be responsible for all costs of the conveyance including, but not limited to, any examination of title, preparation of the deed, excise tax and recording fees. Any announcements made at the sale, including postponement of the sale and withdrawal of the real estate from sale, will take priority over published notices.
