Petition to address the reduced amount of federal income
tax expense experienced between January 1, 2018 and
September 19, 2018, resulting from the 2017 Tax Cuts and
Jobs Act, and the impact to protected and unprotected
excess accumulated deferred income taxes resulting from
the 2017 Tax Cuts and Jobs Act.
NOTICE OF FILING AND HEARING
On December 30, 2019, Peoples Gas WV LLC (Peoples) filed a Petition for Commission approval to address (i) the reduced amount of federal income tax expense experienced between January 1, 2018 and September 19, 2018, (the Stub Period) resulting from the 2017 Tax Cuts and Jobs Act (TCJA) and (ii) the impact to protected and unprotected excess accumulated deferred income taxes (EADIT) resulting from the TCJA. According to Peoples, the Stub Period amount is $2,600 and there is $15,514 in unprotected EADIT and $307,255 in protected EADIT for a net amount of $289,141 to be included in rates in its next rate proceeding. Peoples is not seeking a change in rates in this matter but has requested that the Commission approve the Stub Period amount and unprotected and protected EADIT to be included for ratemaking treatment in its next rate case.

The Commission schedules this matter for evidentiary hearing to be held on August 25, 2021, at 9:30 a.m. at its offices at 201 Brooks Street, Charleston, West Virginia. Because of the COVID-19 pandemic, the Commission will not take in-person public comment at the hearing and will consider written comments and protests. The Commission may determine, in light of the COVID-19 situation, that the scheduled hearing will be conducted virtually, with the parties to the case appearing online. Interested persons should be able to view the evidentiary hearing via an internet livestream. Anyone desiring to intervene should file a written petition to intervene no later than 4:00 p.m., June 16, 2021. Failure to timely intervene may affect your right to participate in the proceeding. All requests to intervene should briefly state the reason for the request to intervene and comply with the rules on intervention set forth in the Commission’s Rules of Practice and Procedure. The Commission will receive public comments and protests until the beginning of the hearing.
