SIDEWALK SNOW REMOVAL
Public hearing and public comment regarding Ordinance #LII, Sidewalk Snow Removal will held at 6:30 p.m., Tuesday, September 13, 2016 at the Capon Bridge Town Hall, 259 Whitacre Lane, Capon Bridge, WV 26711.
Any person wishing to express concerns or comments on Ordinance #52, Sidewalk Snow Removal are welcome to attend, Public comment will be limited to 5 minutes. Those who cannot attend, but wish to express their concerns may do so in writing and mailing to: Ordinance LII, PO Box 183, Capon Bridge, WV 26711. Written concerns will be read aloud during the Public Hearing and Public Comment period.

ORDINANCE LII
AN ORDINANCE PROVIDING FOR REGULATIONS RELATING TO SIDEWALK SNOW REMOVAL
Be it ordained by the Council of the Town of Capon Bridge, Inc.
1) That all property owners or occupants of property within town limits shall clear or cause to be cleared the snow and ice from their sidewalks within 24 hours after the snow ceases to fall.
2) Provide, however, that if the owner or occupants of the property fail to clean or have the snow and ice removed from their sidewalks as above provided then the town authorities shall have the same removed at the expense of the said property owners or occupants of said property.
3) Failure to clear snow and ice from the sidewalk shall be considered a safety hazard and a public nuisance. The penalty shall be not less than ($25), twenty five dollars and not more than ($500.00), five-hundred dollars per day or not to exceed more than ($500), five-hundred dollars per cause or incident.
4) This ordinance shall supersede any previous ordinance governing sidewalk snow removal upon passage of Ordinance LII, Sidewalk Snow Removal.
5) Upon duly made and seconded, the regular rules were suspended and the above ordinance having been passed to be affective from this date.
