Notice is hereby given that the following has been appealed from the action of the City Manager in refusing to grant the following zoning permits:

ITEM 1:
Application # 10,294 by Philip Williams for a permit to erect an approximate 30 x 30 (garage) on vacant lot beside 515 Rogers Street.
Building to be used for garage (carport) on property located at vacant lot on Rogers Street between Pearis Street, 3rd Street, Hoge Street and Rogers Street, Lot 5, Section 312 or County May 17, Parcel No. 353. (Zoning: RMF)
REASON FOR REFUSAL:
Section 44 -90 – Accessory uses in residential areas.
(b) Accessory structures
(1) An accessory structure shall not be more than 20 feet high, nor occupy more than 20 percent of the rear yard.
(3) No accessory structure shall be located less than five feet from an adjoining side yard, nor less than ten feet from any street line or alley.

ITEM 2:
Application #10,293 by John Blevins for a permit to erect an approximate 32 x 30 garage in backyard.
Building to be used for garage on property located at 1312 Stadium Drive between Sylvia Lane, Stadium Drive, Norma Lane, and Lowe Street, Lot 6, Section No. 1150 or County Map 31, Parcel 37. (Zoning: BN)
REASON FOR REFUSAL:
Section 44-143 – Yards
(b) Front yard. In business districts, front yards of the following minimum depth shall be provided. BN= minimum front yard depth 20′.

ITEM 3
Application #10,295 by Rajeev Chopra for a permit to erect an approximate 22′ x 50′ building.
Building to be used for professional office, retail on property located at 1939 Leatherwood Lane (at the church corner of Leatherwood and Whitethorn), between College Avenue, Leatherwood Lane, and Whitethorn Street Ext., Lot 9,10,11,12, Section No 1104 or County Map 42, Parcel No. 64,63,62. (Zoning: BN)
Special Conditions: Landscaping at 5{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}. Needs to get an approved drainage plan and stormwater plan.

ITEM 4:
Application #10,296 by William and Marsha Fuzia for a permit to erect a 4ft. fence along Fulton Street.
Fence would be used on property located at 2115 Fulton Street between Washington Street, Albemarle Street, Fulton Street, and Toledo Street, Section 857 or County Map 39, Parcel No. 140. (Zoned: R-2)
REASON FOR REFUSAL:
Section 44-90 – Accessory uses in residential areas.
(a) Fences or enclosure walls.
(3) A fence or enclosure wall along a street, whether side or rear, shall not exceed three feet in height.
