Notice is hereby given that the following has been appealed from the action of the City Manager in refusing to grant the following zoning permits: ITEM 1:
Application # 10,305 by Carrie A. Harman for a permit to erect a 6ft. high privacy fence with gate in the back yard and being in line with neighbors accessory building.
Building to be used for fence enclosure on property located at 1038 James Street between Hemlock Hill, Pearl Street, and James Avenue, Lot No. 2, Section No. 895 or County Map 43, Parcel No. 109 (Zoning: R-2).

REASON FOR REFUSAL:
Section 44 -90 – Accessory uses in residential areas.
(a) Fences or enclosure walls
(3) A fence or enclosure wall along a street, whether side or rear, shall not exceed three feet in height.

ITEM 2:
Application #10,307 by Troy Akers for a permit to erect a 6ft. high wood fence along the front property line to the set backline of the house on the south side property ling being the side property line.
Building to be used for fence on property located at 2300 Washington Street between Fairmont Street and Washington Street Lot No 10, Section No. 867 or County Map 39, Parcel No. 191 (Zoning: R-2).

REASON FOR REFUSAL:
Section 44-90
(a) Fences or enclosure walls

(1) A fence or enclosure wall shall not exceed a height of three feet when located along the front lot line or when located on any side line, from the front lot line to the setback line. All wire fences are prohibited along front and side lines, except by approval of zoning board of adjustments.

A public hearing will be held in the Board of Directors Room, the Municipal Complex at 200 Rogers Street, Bluefield, West Virginia on August 29, 2019 at 4:30 pm.
