PRE-ADOPTION NEWSPAPER NOTICE
NOTICE
TOWN OF TRIADELPHIA

Notice is hereby given that the Town of Triadelphia, a municipal corporation, will hold a hearing before the final vote on a proposed ordinance, the principal object of which is the increase of sewer rates for customers of the sewer system operated by the Town of Triadelphia. The title of such ordinance is “An Ordinance of the Council of the Town of Triadelphia Adopting Increased Rates and Charges for Sewer Utility Service Provided by the Town of Triadelphia and Setting an Effective Date for Such Rates”.
The rates and charges being proposed are:

The final vote on adoption of said proposed ordinance shall be held in the Council Chambers of the Town of Triadelphia, 4453 National Road, Triadelphia, West Virginia on Wednesday, August 4, 2021, at seven o’clock (7:00) p.m. Interested parties may appear and be heard at such time with respect to the passage of the proposed ordinance. Copies of the proposed ordinance are available at the Office of the Clerk, Town Hall, in Triadelphia.

AN ORDINANCE OF THE COUNCIL OF THE TOWN OF TRIADELPHIA ADOPTING INCREASED RATES AND CHARGES FOR SEWER UTILITY SERVICE PROVIDED BY THE TOWN OF TRIADELPHIA AND SETTING AN EFFECTIVE DATE FOR SUCH RATES

WHEREAS, the Town of Triadelphia, a municipal corporation, through its Sewer Department, has a duty to provide quality sewerage service to the residents and customers of the Town of Triadelphia; and

WHEREAS, the rates and charges for such sewerage service are required by law to be just, reasonable, nondiscriminatory, non-preferential and based primarily on costs of service; and

WHEREAS, the Council of the Town of Triadelphia finds that in order to maintain the operation of the Town Sewer System at efficient levels, to comply with West Virginia Public Service Commission requirements and to comply with provisions of the Sewer Revenue Bond Ordinance of the Town, it is necessary to increase the rates and charges for the Sewer Utility Service.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE TOWN OF TRIADELPHIA:

Section 1: 3.1.02, 3.1.12, and 3.1.13 Code, Town of Triadelphia shall be amended, and as of the effective date set forth hereafter, sewer rates shall be amended, revised, replaced with full substitution by the following rates and charges of Sewerage Service to customers of the Town:

Section 2:

MONTHLY SEWERAGE RATES
First 3,000 gallons treated per month $11.74 per m gallons
Next 7,000 gallons treated per month $9.92 per m gallons
Next 990,000 gallons treated per month $7.04 per m gallons
All Over 1,000,000 gallons treated per month $6.86 per m gallons

MINIMUM CHARGE:
No bill will be rendered for less than thirty-five dollars and twenty-two cents ($35.22) per month

DELAYED PAYMENT PENALTY
The above schedule is net. On all accounts not paid in full within twenty (20) days of the date of the bill, ten percent (10%) will be added to net amount shown.

SERVICE CONNECTION FEES:
Residential connection fee (Sewer Tap Fee) in the amount of four hundred dollars ($400.00) and commercial connection fee (Sewer Tap Fee) of five hundred fifty dollars ($550.00) shall be charged for all new sewer connection installations.

FEE FOR THE DISCONNECTION AND RECONNECTION OF WATER SERVICE:
Non-payment of sewerage bills will result in the disconnection of water service.
Fees for the disconnection and reconnection of water service are twenty-five dollars ($25.00)

LEAK ADJUSTMENT
Three dollars and thirty-five cents ($3.35) per 1,000 gallons of water is to be used when the bill reflects unusual water consumption which can be attributed to eligible leakage on the customer’s side of the meter. This rate shall be applied to all such consumption above the customer’s historic average use.

RETURNED CHECK CHARGE
A service charge equal to the actual fee assessed to the sewer utility up to a maximum of twenty-five dollars ($25.00) will be imposed upon any customer whose check for payment of charges is returned by the bank for any reason.

SERVICE TO OTHER SYSTEMS
Service to the Ohio County Public Service District (the District) is to be charged monthly on the basis of a Sewage Service Agreement dated September 17, 2003, and lasting 40 years from that date, between the District
and the Town of Triadelphia (the Town) at the average unit charge of the City of Wheeling to the Town plus a 10% surcharge. This rate is three dollars and sixty-eight cents ($3.68) per 1,000 gallons of sewerage flowing through the Town’s sewage lines from customers of the District as metered at the points of inflow from the District.

3.1.12 Valley Grove Water Transit Fee
The Town of Triadelphia shall deliver water through its system to Valley Grove from the City of Wheeling at a transit fee of one dollar and twenty-five cents ($1.25) per thousand gallons delivered.

3.1.13 Ohio County Public Service District Transit Fee
The Town of Triadelphia shall deliver water through its system to the Ohio County Public Service District from the City of Wheeling at a transit fee of one dollar and twenty-five cents ($1.25) per thousand gallons delivered.

Section 3 : The rates, fees, charges, delayed payment penalty charges, service connection fee and the fees for disconnection and reconnection of water service provided herein shall be effective forty-five (45) days after the adoption of this ordinance.

Section 4 : The Mayor of the Town of Triadelphia shall file the rates, fees, charges, delayed payment penalty charges, service connection fee and fees for the disconnection and reconnection of water service established by this Ordinance with the Public Service Commission of the State of West Virginia, together with such information showing the basis of such rates, fees, charges, delayed payment penalty charges, service connection fee and fees for the disconnection and reconnection of water service established as the Commission deems necessary.
